Описание:

This book offers a distinctive and novel approach to state-sponsored violence, one of the major problems facing humanity in the previous and now the twenty-first century. It addresses the question: how is it possible that large numbers of ordinary men and women are able to do the killing, torturing and violence that defines crimes against humanity? In his striking analysis, Rob Watts shows how and why states, of all political persuasions, engage in crimes against humanity, including: genocide, homicide, torture, kidnapping, illegal surveillance and detention.
This book advances a new interpretive frame. It argues against the ‘civilizing process’ model, showing how both states and social sciences like sociology and criminology have been complicit in splitting 'the social' from 'the ethical' while accepting too complacently that modern states are the exemplars of morality and rationality. The book makes the case that it is possible to bring together in the one interpretative frame, our understanding of social action involving personal motivation and ethical responsibility and patterns of collective social action operating in terms of the agencies of ‘the State’. Rob Watts identifies and charts the pathways of action and ‘practical’ (i.e. ethical) judgements which the perpetrators of these crimes against humanity constructed for themselves to make sense of what they were doing.
At once challenging and highly accessible, the book reveals the policy-making processes that produce state crime as well as showing how ordinary people do the state’s dirty work.

Описание: Undue Process: Taking the Law Out of Law Enforcement raises the reader's awareness of an important constitutional issue that has yet to receive significant attention despite its impact on contemporary life, law, and society. The book analyzes how the vast expansion of private security has undermined citizens’ constitutional rights to due process and equal protection. Most analyses of the expansion of private security have focused on the way this type of security encroaches on the right to privacy. Undue Process moves beyond this question to examine the way in which privatized law enforcement has begun to erode America's historic commitment to equality under the law. The opening chapters of the text explain the world of private security and examine how it has rapidly expanded due to budget-conscious limits on police capacity. Additional chapters explore the public-private hybrid form of law enforcement that has emerged in America as a result, along with specific constitutional issues raised by netlaw, private prisons, and the activities of bounty hunters. Undue Process is well-suited to political science and government courses and classes on criminal justice, constitutional law, and police procedures.

Описание: The United States incarcerates nearly one quarter of the world's prison population with only five percent of its total inhabitants, in addition to a history of using internment camps and reservations. An overreliance on incarceration has emphasized long-standing and systemic racism in criminal justice systems and reveals a need to critically examine current processes in an effort to reform modern systems and provide the best practices for successfully responding to deviance. Global Perspectives on People, Process, and Practice in Criminal Justice is an essential scholarly reference that focuses on incarceration and imprisonment and reflects on the differences and alternatives to these policies in various parts of the world. Covering subjects from criminology and criminal justice to penology and prison studies, this book presents chapters that examine processes and responses to deviance in regions around the world including North America, Europe, the Middle East, and Asia. Uniquely, this book presents chapters that give a voice to those who are not always heard in debates about incarceration and justice such as those who have been incarcerated, family members of those incarcerated, and those who work within the walls of the prison system. Investigating significant topics that include carceral trauma, prisoner rights, recidivism, and desistance, this book is critical for academicians, researchers, policymakers, advocacy groups, students, government officials, criminologists, and other practitioners interested in criminal justice, penology, human rights, courts and law, victimology, and criminology.
