Описание: Since the first edition of this popular text was published in 1984, the Charter of Rights and Freedoms has transformed the role of the courts in Canadian politics. Newly revised and updated, Law, Politics, and the Judicial Process in Canada, 4th Edition provides an introduction to the issues raised by the changing political role of Canadian judges. It includes over 40 new readings, including two all-new chapters on the Harper Conservatives and Aboriginal Law. Addressing current controversies, including the Canadian Judicial Council's investigations into Justice Robin Camp and Lori Douglas and the Trudeau Government's re-introduction of the Court Challenges Program, this book strives for competing perspectives, with many readings juxtaposed to foster debate. Taking a critical approach to the Charter of Rights and Freedoms and the growth of judicial power, editors F.L. Morton and Dave Snow provide an even-handed examination of current and ongoing issues. Law, Politics, and the Judicial Process in Canada, 4th Edition is the leading source for students interested in the Charter of Rights and Freedoms and the growth of judicial power in Canada.

Описание: Indonesia's judicial system has long been described as dysfunctional. Many of its problems developed out of decades of authoritarian rule, which began in the last few years of the reign of Indonesia's first president, Soekarno. By the time President Soeharto's regime fell in 1998, the judiciary had virtually collapsed. Judicial dependence on government, inefficiency and corruption were commonly seen as the main indicators of poor performance, resulting in very low levels of public trust in the courts. To address these problems, reformists focused on improving judicial independence. Yet while independence is a basic prerequisite for adequate judicial performance, much depends on how this independence is exercised. Judicial Dysfunction in Indonesia demonstrates that Indonesian courts have tended to act without accountability and offers detailed analysis of highly controversial decisions by Indonesian courts, many of which have been of major political significance, both domestically and internationally. It sets out in concrete terms, for the first time, how bribes are negotiated and paid to judges and demonstrates that judges have issued poor decisions and engaged in corruption and other misconduct, largely without fear of retribution. Further, it explores unsafe convictions and public pressure as a threat to judicial independence. Judicial Dysfunction in Indonesia shines a sorely needed empirical light on the Indonesian judicial system, and is an essential resource for readers, scholars and students of Indonesian law and society.
When the Supreme Court of Canada makes a decision that invalidates a statute, it creates a constitutional moment. But does that have a direct and observable impact on public policy? Constraining the Court explores what happens when a statute involving a significant public policy issue – French language rights in Quebec, supervised consumption sites, abortion, or medical assistance in dying – is declared unconstitutional. James B. Kelly examines the conditions under which Parliament or provincial/territorial legislatures attempt to contain the policy impact of judicial invalidation and engage in non-compliance without invoking the notwithstanding clause. He considers the importance of the issue, the unpopularity of a judicial decision, the limited reach of a negative rights instrument such as the Charter, the context of federalism, and the mixture of public and private action behind any legislative response. While the Supreme Court’s importance cannot be denied, this rigorous analysis convincingly concludes that a judicial decision does not necessarily determine a policy outcome.

Описание: This book presents an empirical analysis of the UK Supreme Court’s output over its first ten years, with a specific focus on each individual judge’s contribution to each case. It shows that judges, like all of us, are human; it would be difficult to imagine that any of us, even in our most professional capacity, could act completely independently of our predilections, motivations and biases. The same is true for the judges sitting on the UK’s highest court.Drawing on insights from a bespoke dataset of judgments, this work discerns trends and tendencies across each judge’s voting patterns and the reasoning they adopt when disposing of cases. It not only highlights areas of divergence, but also shows how each of the judges tended to vote in different contexts, including which were more likely to overturn appeals from lower courts, side with certain parties such as the state or underdogs, and find liability in various areas (tort, contract, criminal, EU, immigration and tax law, with a special focus on human rights cases). Another section illustrates the differences between the judges when it comes to judicial reasoning, such as their approach to precedent and preferred methods of statutory interpretation. This work shows that different judges exercise their power in different ways. Some are more comfortable with pushing boundaries whilst others are more restrained. Some grant the state a lot of leeway whilst others apply heavy scrutiny. Some are, as Lord Denning suggested, 'bold spirits' whilst others are 'timorous souls'. It shows, at least when it comes to the Supreme Court, that it matters who our judges are.
