The early American legal system permeated the lives of colonists and reflected their sense of what was right and wrong, honorable and dishonorable, moral and immoral. In a compelling book full of the extraordinary stories of ordinary people, Elaine Forman Crane reveals the ways in which early Americans clashed with or conformed to the social norms established by the law. As trials throughout the country reveal, alleged malefactors such as witches, wife beaters, and whores, as well as debtors, rapists, and fornicators, were as much a part of the social landscape as farmers, merchants, and ministers. Ordinary people "made" law by establishing and enforcing informal rules of conduct. Codified by a handshake or over a mug of ale, such agreements became custom and custom became "law." Furthermore, by submitting to formal laws initiated from above, common folk legitimized a government that depended on popular consent to rule with authority.
In this book we meet Marretie Joris, a New Amsterdam entrepreneur who sues Gabriel de Haes for calling her a whore; peer cautiously at Christian Stevenson, a Bermudian witch as bad "as any in the world;" and learn that Hannah Dyre feared to be alone with her husband—and subsequently died after a beating. We travel with Comfort Taylor as she crosses Narragansett Bay with Cuff, an enslaved ferry captain, whom she accuses of attempted rape, and watch as Samuel Banister pulls the trigger of a gun that kills the sheriff's deputy who tried to evict Banister from his home. And finally, we consider the promiscuous Marylanders Thomas Harris and Ann Goldsborough, who parented four illegitimate children, ran afoul of inheritance laws, and resolved matters only with the assistance of a ghost. Through the six trials she skillfully reconstructs here, Crane offers a surprising new look at how early American society defined and punished aberrant behavior, even as it defined itself through its legal system.

Описание: Religious conflicts had a pronounced effect on women and their families in early modern England, but our understanding of that impact is limited by the restrictions that prevented the open expression of religious beliefs in the post-Reformation years. More can be gleaned by shifting our focus to the New World, where gender relations and family formations were largely unhampered by the unsettling political and religious climate of England. In Maryland, English Arminian Catholics, Particular Baptists, Presbyterians, Puritans, Quakers, and Roman Catholics lived and worked together for most of the 17th century. By closely examining thousands of wills and other personal documents, as well as early Maryland's material culture, this transatlantic study depicts women's place in society and the ways religious values and social arrangements shaped their lives. Common Whores, Vertuous Women, and Loveing Wives takes a revisionist approach to the study of women and religion in colonial Maryland and adds considerably to our understanding of the social and cultural importance of religion in early America.

Описание: In Glorious Temples or Babylonic Whores Anne-Fran oise Morel offers an account of the intellectual and cultural history of places of worship in Stuart England. Official documents issued by the Church of England rarely addressed issues regarding the status, function, use, and design of churches; but consecration sermons turn time and again to the conditions and qualities befitting a place of worship in Post-Reformation England. Placing the church building directly in the midst of the heated discussions on the polity and ceremonies of the Church of England, this book recovers a vital lost area of architectural discourse. It demonstrates that the religious principles of church building were enhanced by, and contributed to, scientific developments in fields outside the realm of religion, such as epistemology, theory of sense perception, aesthetics, rhetoric, antiquarianism, and architecture.

Описание: On 13 June 1525, Martin Luther married Katharina von Bora, a former nun, in a private ceremony officiated by city preacher Johann Bugenhagen. Whilst Luther was not the first former monk or Reformer to marry, his marriage immediately became one of the iconic episodes of the Protestant Reformation. From that point on, the marital status of clergy would be a pivotal dividing line between the Catholic and Protestant churches. Tackling the early stages of this divide, this book provides a fresh assessment of clerical marriage in the first half of the sixteenth century, when the debates were undecided and the intellectual and institutional situation remained fluid and changeable. It investigates the way that clerical marriage was received, and viewed in the dioceses of Mainz and Magdeburg under Archbishop Albrecht of Brandenburg from 1513 to 1545. By concentrating on a cross-section of rural and urban settings from three key regions within this territory - Saxony, Franconia, and Swabia - the study is able to present a broad comparison of reactions to this contentious issue. Although the marital status of the clergy remains perhaps the most identifiable difference between Protestant and Roman Catholic churches, remarkably little research has been done on how the shift from a "celibate" to a married clergy took place during the Reformation in Germany or what reactions such a move elicited. As such, this book will be welcomed by all those wishing to gain greater insight, not only into the theological debates, but also into the interactions between social identity, governance, and religious practice.

Examines the role of the American Revolution in the everyday lives of women Patriarchal forces of law, finance, and social custom restricted women’s rights and agency in revolutionary America. Yet women in this period exploited these confines, transforming constraints into vehicles of female empowerment. Through a close reading of thousands of legislative, judicial, and institutional pleas across seventy years of history in three urban centers, Jacqueline Beatty illustrates the ways in which women in the revolutionary era asserted their status as dependents, demanding the protections owed to them as the assumed subordinates of men. In so doing, they claimed various forms of aid and assistance, won divorce suits, and defended themselves and their female friends in the face of patriarchal assumptions about their powerlessness. Ultimately, women in the revolutionary era were able to advocate for themselves and express a relative degree of power not in spite of their dependent status, but because of it. Their varying degrees of success in using these methods, however, was contingent on their race, class, and socio-economic status, and the degree to which their language and behavior conformed to assumptions of Anglo-American femininity. In Dependence thus exposes the central paradoxes inherent in American women’s social, legal, and economic positions of dependence in the Revolutionary era, complicating binary understandings of power and weakness, of agency and impotence, and of independence and dependence. Significantly, the American Revolution provided some women with the language and opportunities in which to claim old rights—the rights of dependents—in new ways. Most importantly, In Dependence shows how women’s coming to consciousness as rights-bearing individuals laid the groundwork for the activism and collective petitioning efforts of later generations of American feminists.
