Описание: Sharing the Land, Sharing a Future looks to both the past and the future as it examines the foundational work of the Royal Commission on Aboriginal Peoples (RCAP) and the legacy of its 1996 report. It assesses the Commission’s influence on subsequent milestones in Indigenous-Canada relations and considers our prospects for a constructive future.RCAP’s five-year examination of the relationships of First Nations, Metis, and Inuit peoples to Canada and to non-Indigenous Canadians resulted in a new vision for Canada and provided 440 specific recommendations, many of which informed the subsequent work of the Truth and Reconciliation Commission of Canada (TRC). Considered too radical and difficult toimplement, RCAP’s recommendations were largely ignored, but the TRC reiterates that longstanding inequalities and imbalances in Canada’s relationship with Indigenous peoples remain and quite literally calls us to action. With reflections on RCAP’s legacy by its co-chairs, leaders of national Indigenous organizations and the Minister of Indigenous Crown Relations, and leading academics and activists, this collection refocuses our attention on the groundbreaking work already performed by RCAP. Organized thematically, it explores avenues by which we may establish a new relationship, build healthy and powerful communities, engage citizens, and move to action.

The first ethnography of the vibrant Aboriginal media community in Vancouver, Sovereign Screens uncovers the social forces shaping that community, including community media organizations and avant-garde art centers, as well as the national spaces of cultural policy and media institutions.
Kristin L. Dowell uses the concept of visual sovereignty to examine the practices, forms, and meanings through which Aboriginal filmmakers tell their individual stories and those of their Aboriginal nations and the intertribal urban communities in which they work. She explores the ongoing debates within the community about what constitutes Aboriginal media, how this work intervenes in the national Canadian mediascape, and how filmmakers use technology in a wide range of genres—including experimental media—to recuperate cultural traditions and reimagine Aboriginal kinship and sociality. Analyzing the interactive relations between this social community and the media forms it produces, Sovereign Screens offers new insights into the on-screen and off-screen impacts of Aboriginal media.
Fragile Settlements compares the processes by which colonial authority was asserted over Indigenous people in south-west Australia and prairie Canada from the 1830s to the early twentieth century. At the start of this period, there was an explosion of settler migration across the British Empire. In a humanitarian response to the unprecedented demand for land, Britain’s Colonial Office moved to protect Indigenous peoples by making them subjects under British law. This book highlights the parallels and divergences between these connected British frontiers by examining how colonial actors and institutions interpreted and applied the principle of law in their interaction with Indigenous peoples on the ground. Fragile Settlements questions the finality of settler colonization and contributes to ongoing debates around jurisdiction, sovereignty, and the prospect of genuine Indigenous-settler reconciliation in Canada and Australia.

Автор: Bruce Granville Miller Название: Oral History on Trial: Recognizing Aboriginal Narratives in the Courts ISBN: 0774820713 ISBN-13(EAN): 9780774820714 Издательство: Wiley EDC Рейтинг: Цена: 29730.00 T Наличие на складе: Невозможна поставка. Описание: This important book breaks new ground by asking how oral histories might be incorporated into existing text-based, “black letter law” court systems. Along with a compelling analysis of Aboriginal, legal, and anthropological concepts of fact and evidence, Oral History on Trial traces the long trajectory of oral history from community to court, and offers a sophisticated critique of the Crown’s use of Aboriginal materials in key cases. A bold intervention in legal and anthropological scholarship, Oral History on Trial presents a powerful argument for a reconsideration of the Crown’s approach to oral history.
Scholars often accept without question that the Indian Act (1876) criminalized First Nations. In this illuminating book, Shelley Gavigan argues that the notion of criminalization captures neither the complexities of Aboriginal participation in the criminal courts nor the significance of the Indian Act as a form of law.
Gavigan draws on court files, police and penitentiary records, and newspaper accounts and insights from critical criminology to interrogate state formation and criminal law in the Saskatchewan region of the North-West Territories between 1870 and 1905. By focusing on Aboriginal people’s participation in the courts rather than on narrow categories such as “the state” and “the accused,” Gavigan allows Aboriginal defendants, witnesses, and informants to emerge in vivid detail and tell the story in their own terms. Their experiences stand as evidence that the criminal law and the Indian Act operated in complex and contradictory ways that included both the mediation and the enforcement of relations of inequality.

Автор: Jamie D. Dickson Название: The Honour and Dishonour of the Crown: Making Sense of Aboriginal Law in Canada ISBN: 1895830834 ISBN-13(EAN): 9781895830835 Издательство: Mare Nostrum (Eurospan) Рейтинг: Цена: 32190.00 T Наличие на складе: Невозможна поставка. Описание: In Canada, the fundamentals of law relating to Aboriginal peoples are unclear and Indigenous communities lack appropriate guidance in terms of efficiently accessing the legal system to address breaches of their rights. This is yet another injustice endured by Aboriginal peoples in Canada. However, the Supreme Court of Canada has begun to place greater emphasis on the honour-of-the-Crown principle and less on the paternalistic, complex notion that governments owe a fiduciary duty to Aboriginal peoples. Dickson explores both theoretical and practical implications of this fundamental shift and possible future outcomes.
