Описание:

Over the past few decades, there has been a sharp increase in the number of elderly prisoners, and hence a rise in the number of prisoners dying in custody. In this book, Khechumyan questions whether respect for human dignity would justify releasing older and seriously ill prisoners. He also examines the normative justifications which could limit the administration of the imprisonment of the elderly and seriously ill.

Khechumyan argues that factors such as a prisoner's age and health could alter the balance between the legitimate goals of punishment, rendering the continued imprisonment 'grossly disproportionate'. To address these issues, Articles 3 and 5 of the European Convention of Human Rights are extensively examined.

This book is a valuable resource for academics, researchers and policy-makers working in the fields of Criminal Justice, Human Rights Law, and Gerontology.

Compelling interviews uncover why tough drug policies disproportionately impact women in the American prison system
Since the 1980s, when the War on Drugs kicked into high gear and prison populations soared, the increase in women’s rate of incarceration has steadily outpaced that of men. As a result, women’s prisons in the US have suffered perhaps the most drastically from the overcrowding and recurrent budget crises that have plagued the penal system since harsher drugs laws came into effect. In Breaking Women, Jill A. McCorkel draws upon four years of on-the-ground research in a major US women’s prison to uncover why tougher drug policies have so greatly affected those incarcerated there, and how the very nature of punishment in women’s detention centers has been deeply altered as a result.
Through compelling interviews with prisoners and state personnel, McCorkel reveals that popular so-called “habilitation” drug treatment programs force women to accept a view of themselves as inherently damaged, aberrant addicts in order to secure an earlier release. These programs were created as a way to enact stricter punishments on female drug offenders while remaining sensitive to their perceived feminine needs for treatment, yet they instead work to enforce stereotypes of deviancy that ultimately humiliate and degrade the women. The
prisoners are left feeling lost and alienated in the end, and many never truly address their addiction as the programs’ organizers may have hoped. A fascinating and yet sobering study, Breaking Women foregrounds the
gendered and racialized assumptions behind tough-on-crime policies while offering a vivid account of how the
contemporary penal system impacts individual lives.

Описание:

Prisons and imprisonment have become a commonplace topic in popular culture as the setting and rationale for fiction and documentaries and most people seem to have a clear notion of what it is like in prison, ranging from the idea of the prison cell as a cosy nook with fast internet access to that of a dungeon with a hard bed and a diet of bread and water. But what is prison really like? Do prisoners have the same rights as everyone else? What are the similarities and differences between prisons in different European countries?

This book answers all of these questions, whilst also presenting cutting-edge research on the living conditions of long-term prisoners in Europe and considering whether these conditions meet international human rights standards. Bringing together leading experts in the field, with comprehensive coverage of the issues in Belgium, Croatia, Denmark, England, Finland, France, Germany, Lithuania, Poland, Spain and Sweden, this book offers the first comparative study on the subject.

Whereas past research in this area has concentrated on the Anglo-American experience, this book offers a truly comparative European approach and pays due attention to the differences in prison systems between the post-Soviet countries and continental Europe. This book will be key reading for academics and students of criminology, criminal justice and penology and will also be of interest to students and practitioners of law.

Описание: Life imprisonment is the most severe penalty that can be imposed by the criminal justice system. Despite this, it is a relatively under-researched form of punishment. No meaningful attempt has been made to understand its human rights implications. This important collection fills that gap by addressing these two key questions: namely what is life imprisonment and what human rights are relevant to it? These questions are explored from the perspective of a range of jurisdictions, and a dual perspective drawing on both empirical and doctrinal research is offered. Under the editorship of two leading scholars in the field, this innovative and important work will be a landmark publication in the field of penal studies and human rights. Описание:

One out of every ten prisoners in the United States is serving a life sentence—roughly 130,000 people. While some have been sentenced to life in prison without parole, the majority of prisoners serving ‘life’ will be released back into society. But what becomes of those people who reenter the everyday world after serving life in prison?
In After Life Imprisonment, Marieke Liem carefully examines the experiences of “lifers” upon release. Through interviews with over sixty homicide offenders sentenced to life but granted parole, Liem tracks those able to build a new life on the outside and those who were re-incarcerated. The interviews reveal prisoners’ reflections on being sentenced to life, as well as the challenges of employment, housing, and interpersonal relationships upon release. Liem explores the increase in handing out of life sentences, and specifically provides a basis for discussions of the goals, costs, and effects of long-term imprisonment, ultimately unpacking public policy and discourse surrounding long-term incarceration. A profound criminological examination, After Life Imprisonment reveals the untold, lived experiences of prisoners before and after their life sentences.

Описание: Life imprisonment is the punishment most often imposed worldwide for what societies regard as the most serious offences. Yet, in Asia the phenomenon has never been studied systematically. Life Imprisonment in Asia fills this major gap. It brings together thirteen new essays on life imprisonment in key jurisdictions in the region. Each chapter consolidates what is known about the law and practice of life imprisonment in the jurisdiction and then explores aspects of the imposition or implementation of life sentences that the authors regard as particularly problematic. In some instances, the main issue is the imposition of life sentences by the courts and their relationship to the death penalty. In others, the focus is on the treatment of life sentenced prisoners. In many instances, the most prominent question is whether life sentenced prisoners should be released and, if so, according to what processes. In the overview chapter, the editors place the complex picture that emerges of life imprisonment in Asia in a global context and point to reforms urgently required to ensure that Asian life sentences meet international human rights standards. Life Imprisonment in Asia should be read by everyone who has an interest in just punishments for serious offences, not only in Asia, but throughout the world. It will be an invaluable tool for lawyers, criminologists, policy makers and penal reform advocates in the region and beyond.
