Описание: This book explores how the law and the institutions of the criminal justice system expose minorities to different types of violence, either directly, through discrimination and harassment, or indirectly, by creating the conditions that make them vulnerable to violence from other groups of society. It draws on empirical insights across a broad array of communities and locales including Afghanistan, Colombia, Pakistan, India, Malawi, Turkey, Brazil, Singapore, Puerto Rico, and the Philippines. It examines the challenges of protecting those at the margins of power, especially those whom the law is often used to oppress. The chapters explore intersecting, marginal identities influenced by four factors: rebuilding after violent regimes, economic interest behind the violence, entrenched cultural biases, and criminalisation of diversity. It provides scholars from the Global North with important lessons when attempting to impose their own solutions onto nations with a different history and context, or when applying their own laws to migrants from the Global South nations explored in this book. It speaks to legal and social science scholars in the fields of law, sociology, criminology, and social work.
Дополнительное описание: Part I. Rebuilding after violence.- Chapter 1. The Caradiru Prison Massacre and Ongoing Military Repression in Brazil (Emilio Meyer, Marta Machado).- Chapter 2. Politics before Law: The New Penal Code of 2017 and its Limited Protections for Ethnic Minorit

Описание:

The murder of unarmed teenager Trayvon Martin and the subsequent trial and acquittal of his assailant, George Zimmerman, sparked a passionate national debate about race and criminal justice in America that involved everyone from bloggers to mayoral candidates to President Obama himself. With increased attention to these causes, from St. Louis to Los Angeles, intense outrage at New York City’s Stop and Frisk program and escalating anger over the effect of mass incarceration on the nation’s African American community, the Trayvon Martin case brought the racialized nature of the American justice system to the forefront of our national consciousness. Deadly Injustice uses the Martin/Zimmerman case as a springboard to examine race, crime, and justice in our current criminal justice system.
Contributors explore how race and racism informs how Americans think about criminality, how crimes are investigated and prosecuted, and how the media interprets and reports on crime. At the center of their analysis sit examples of the Zimmerman trial and Florida’s controversial Stand Your Ground law, providing current and resonant examples for readers as they work through the bigger-picture problems plaguing the American justice system. This important volume demonstrates how highly publicized criminal cases go on to shape public views about offenders, the criminal process, and justice more generally, perpetuating the same unjust cycle for future generations. A timely, well-argued collection, Deadly Injustice is an illuminating, headline-driven text perfect for students and scholars of criminology and an important contribution to the discussion of race and crime in America.

Описание: In Struggles for the Human, Lara Montesinos Coleman blends ethnography, political philosophy, and critical theory to reorient debates on human rights through attention to understandings of legality, ethics, and humanity in anticapitalist and decolonial struggle. Drawing on her extensive involvement with grassroots social movements in Colombia, Coleman observes that mainstream expressions of human rights have become counterparts to capitalist violence, even as this discourse disavows capitalism’s deadly implications. She rejects claims that human rights are inherently tied to capitalism, liberalism, or colonialism, instead showing how human rights can be used to combat these forces. Coleman demonstrates that social justice struggles that are rooted in marginalized communities’ lived experiences can reframe human rights in order to challenge oppressive power structures and offer a blueprint for constructing alternative political economies. By examining the practice of redefining human rights away from abstract universals and contextualizing them within concrete struggles for justice, Coleman reveals the transformative potential of human rights and invites readers to question and reshape dominant legal and ethical narratives.

Описание: This timely book comprehensively examines whether the worst human rights violations directed specifically at sexual and gender minorities are punishable under international criminal law, as codified in the Rome Statute of the International Criminal Court. Drawing on general rules of interpretation, the development of human rights for sexual and gender minorities, and the social construction of gender, this monograph reveals that the worst crimes committed against persons because of their sexual orientation or gender identity can amount to crimes against humanity, particularly the crime of persecution under Article 7(1)(h). It also shows how legislators can be held individually criminally responsible for passing laws that criminalize consensual same-sex sexuality. The book not only makes a significant and original contribution to the literature but is also highly relevant for international criminal law practitioners, since, so far, no cases regarding this topic exist. Dr. Val?rie V. Suhr is currently a trainee lawyer in the district of the Koblenz Court of Appeal in Germany

Описание: Race and Criminal Justice History: Rhetoric, Politics, and Policy helps students understand the complicated connection between the criminal justice system and the politics of race in America. Through socio-legal, socio-psychological and socio-historical analysis of racism and the history of American political rhetoric on crime, the text provides a foundation for understanding how African Americans are perceived in modern society and how long-standing negative perceptions have influenced their interactions with the criminal justice system. The text begins with a discussion on how criminal justice policy and perceptions of criminality are related to African American disproportionate incarceration. Through a socio-psychological lens, it explains how African Americans are stereotyped as criminals, as well as how the biological, sociological, and psychological science of racial bias, prejudice, and racism can influence police interactions. Later chapters provide a detailed and in-depth review of how antebellum and postbellum politics defending states’ rights, the adoption of Jim Crow by the Supreme Court, presidential level political rhetoric regarding Black inferiority, criminality and segregation, as well as the use of the criminal justice system as means of social control of former slaves, all form the context for understanding the development of the modern criminal justice policies implemented during the presidencies of Johnson through Trump. Thorough in historical and psychological analysis, and timely in light of current social and political events, Race and Criminal Justice History is an ideal text for criminal justice, sociology, psychology, social work, political science, public administration, public policy, and race and ethnic studies courses.
