Описание: This book answers key questions about the relationship between administrative justice institutions and government officials through a new theoretical model, derived from an innovative analysis of interdisciplinary literature and an empirical case study. This groundbreaking model develops existing work on the control of bureaucracy by emphasising three under-explored areas: - the nature of the issues which citizens raise and the ways in which the matters are presented - the fundamental structure of government decision-making whereby different forms of organisation produces different responses to attempts by administrative justice institutions to achieve control- the operational practices of administrative justice institutions, where comparisons between three distinctive institutions help to identify features of institutional design that facilitate or prevent the exercise of control. The book concludes by assessing where the balance should be struck between legal control and government autonomy. Fundamentally, the model advanced in the book problematises the idea of government control by administrative justice institutions and argues for attention to be paid to the limits of legal control and the importance of context when assessing these issues.

Описание: In The Journey to Separate but Equal: Madame Decuir's Quest for Racial Justice in the Reconstruction Era, Jack Beermann tells the story of how, in Hall v. Decuir, the post-Civil War US Supreme Court took its first step toward perpetuating the subjugation of the non-White population of the United States by actively preventing a Southern state from prohibiting segregation on a riverboat in the coasting trade on the Mississippi River. The Journey to Separate but Equal offers the first complete exploration of Hall v. Decuir, with an in-depth look at the case's record; the lives of the parties, lawyers, and judges; and the case's social context in 1870s Louisiana. The book centers around the remarkable story of Madame Josephine Decuir and the lawsuit she pursued because she had been illegally barred from the cabin reserved for White women on the Governor Allen riverboat. The drama of Madame Decuir's fight against segregation's denial of her dignity as a human and particularly as a woman enriches our understanding of the Reconstruction era, especially in Louisiana, including political and legal changes that occurred during that time and the plight of people of color who were freed from slavery but denied their dignity and rights as American citizens. Hall v. Decuir spanned the pivotal period of 1872-1878, during which White segregationist Democrats 'redeemed' the South from Republican control. The Supreme Court's ruling in Hall overturned the application of an 1869 Louisiana statute prohibiting racial segregation in Madame Decuir's case because of the status of the Mississippi River as a mode of interstate commerce. The decision represents a crucial precedent that established the legal groundwork for the entrenchment of Jim Crow in the law of the United States, leading directly to the Court's adoption of "separate but equal" in Plessy v. Ferguson.

Описание: Who determines the fuel standards for our cars? What about whether Plan B, the morning-after pill, is sold at the local pharmacy? Many people assume such important and controversial policy decisions originate in the halls of Congress. But the choreographed actions of Congress and the president account for only a small portion of the laws created in the United States. By some estimates, more than ninety percent of law is created by administrative rules issued by federal agencies like the Environmental Protection Agency and the Department of Health and Human Services, where unelected bureaucrats with particular policy goals and preferences respond to the incentives created by a complex, procedure-bound rulemaking process.

With Bending the Rules, Rachel Augustine Potter shows that rulemaking is not the rote administrative activity it is commonly imagined to be but rather an intensely political activity in its own right. Because rulemaking occurs in a separation of powers system, bureaucrats are not free to implement their preferred policies unimpeded: the president, Congress, and the courts can all get involved in the process, often at the bidding of affected interest groups. However, rather than capitulating to demands, bureaucrats routinely employ "procedural politicking," using their deep knowledge of the process to strategically insulate their proposals from political scrutiny and interference. Tracing the rulemaking process from when an agency first begins working on a rule to when it completes that regulatory action, Potter show how bureaucrats use procedures to resist interference from Congress, the President, and the courts at each stage of the process. This exercise reveals that unelected bureaucrats wield considerable influence over the direction of public policy in the United States.

Описание: How do you defend democracy? How do you protect your rights? How can you repeal a law that interferes with your sphere of rights? These are some of the questions that any citizen in a democratic country should know in order to enjoy his/her freedom and rights. Even a small country like Albania is no exception. New and modern Constitutions, aim to regulate the exercise of state power, based on the principle of separation of powers and to the respect for human rights and fundamental freedoms. Despite the fact that this important principle helps to control the activity between different state institutions, the history has shown that this has not always been an efficient solution. So, the world is full of examples where a parliamentary majority, that have come to power through democratic processes, has used its power to control the others power of a country and had violated the human rights and fundamental freedoms. For this reason, the drafters of the constitution after the Second World War in Western Europe and after the fall of communism in Eastern European countries, have established and regulated the creation of the Constitutional Court as an institution which can defend the sphere of the competencies of other institutions with constitutional nature and the protection of human rights and fundamental freedoms. This possibility can only be realized using procedural means, through which the Constitutional Court is put into motion. The purpose of this book is precisely, to analyze these procedural mechanisms with regard to the principles of the constitutional process, the jurisdictions, the admissibility of the applications, the procedural position of the parties, the terms and their calculation, procedural acts and evidence that can be used, as well as, procedural characteristics for each constitutional process. A good knowledge of these principles and rules of procedure helps the different applicants who presented themselves to the Constitutional Court to have higher chances to succeed and to be accepted instead of being dismissing because of procedural deficiencies. This book show all of this aspects in the content of the Albanian experience.

Описание: When the Founders penned the Fourth Amendment to the Constitution, it was not difficult to identify the “persons, houses, papers, and effects” they meant to protect; nor was it hard to understand what “unreasonable searches and seizures” were. The Fourth Amendment was intended to stop the use of general warrants and writs of assistance and applied primarily to protect the home. Flash forward to a time of digital devices, automobiles, the war on drugs, and a Supreme Court dominated by several decades of the jurisprudence of crime control, and the legal meaning of everything from “effects” to “seizures” has dramatically changed. Michael C. Gizzi and R. Craig Curtis make sense of these changes in The Fourth Amendment in Flux. The book traces the development and application of search and seizure law and MYUjurisprudence over time, with particular emphasis on decisions of the Roberts Court. Cell phones, GPS tracking devices, drones, wiretaps, the Patriot Act, constantly changing technology, and a political culture that emphasizes crime control create new challenges for Fourth Amendment interpretation and jurisprudence. This work exposes the tensions caused by attempts to apply pretechnological legal doctrine to modern problems of digital privacy. In their analysis of the Roberts Court’s relevant decisions, Gizzi and Curtis document the different approaches to the law that have been applied by the justices since the Obama nominees took their seats on the court. Their account, combining law, political science, and history, provides insight into the court’s small group dynamics, and traces changes regarding search and seizure law in the opinions of one of its longest serving members, Justice Antonin Scalia. At a time when issues of privacy are increasingly complicated by technological advances, this overview and analysis of Fourth Amendment law is especially welcome—an invaluable resource as weaddress the enduring question of how to balance freedom against security in the context of the challenges of the twenty-firstcentury.

Описание: This book explores the implications of freedom as a non-domination-oriented view for understanding EU security regulation and its constitutional implications. At a time when the European borders are under pressure and with the refugee and migration crisis, which escalated in 2015, the idea of exploring a constitutional theory for the ‘Area of Freedom, Security and Justice’ (AFSJ) might seem to be a utopian project. This appears especially true in the light of the increased threat of terrorism in Europe (and on a global scale) and where the expanding EU security agenda is often advanced through the administrative law path, in contrast to the constitutional trajectory. Add to this the prolonged financial crisis, which continues to cast a long shadow on the future development of EU integration, and which suggests that Europe needs to ‘re-invent itself’ beyond the sphere of economics. Therefore, it is precisely because of the current uncertainties regarding the progress of the EU and the constitutional law project that a constitutional take on the AFSJ is of particular importance. The book investigates the meaning of non-domination and the idea of justice and justification in the area of EU security regulation. In doing so, it focuses on the development of an AFSJ, what it means, and why it represents a fascinating example of contemporary constitutional law with interacting layers of security regulation, human rights law and transnational legal theory at its core.

Описание: How does the state, as a public authority, relate to those under its jurisdiction through the criminal law? Connecting the ways in which criminal lawyers, legal theorists, public lawyers and criminologists address questions of the criminal law’s legitimacy, contributors to this collection explore issues such as criminal law-making and jurisdiction; the political-ethical underpinnings of legitimate criminal law enforcement; the offence of treason; the importance of doctrinal guidance in the application of criminal law; the interface between tort and crime; and the purposes and mechanisms of state punishment. Overall, the collection aims to enhance and deepen our understanding of criminal law by conceiving of the practices of criminal justice as explicitly and distinctly embedded in the project of liberal self-governance.
