This book configures a consistent epistemology of biolaw that distinguishes itself from bioethics and from a mere set of international instruments on the regulation of biomedical practices. Описание: This edited volume covers new ground by bringing together perspectives from symbolic legislation theory on the one hand, and from biolaw and bioethics on the other hand.Symbolic legislation has a bad name. It usually refers to instances of legislation which are ineffective and that serve other political and social goals than the goals officially stated. Recently, a more positive notion of symbolic legislation has emerged in legislative theory. From this perspective, symbolic legislation is regarded as a positive alternative to the more traditional, top-down legislative approach. The legislature no longer merely issues commands backed up with severe sanctions, as in instrumental legislation. Instead, lawmakers provide open and aspirational norms that are meant to change behavior not by means of threat, but indirectly, through debate and social interaction.Since the 1990s, biomedical developments have revived discussions on symbolic legislation. One of the reasons is that biomedical legislation touches on deep-rooted, symbolic-cultural representations of the biological aspects of human life. Moreover, as it is often impossible to reach consensus on these controversial questions, legislators have sought alternative ways to develop legal frameworks. Consequently, communicative and interactive approaches to legislation are prominent within the governance of medical biotechnology.The symbolic dimensions of biolaw are often overlooked. Yet, it is clear that the symbolic is at the heart of many legal-political debates on bioethical questions. Since the rise of biomedical technologies, human body materials have acquired a scientific, medical and even commercial value. These new approaches, which radically question existing legal symbolizations of the human body, raise the question whether and how the law should continue to reflect symbolic values and meanings. In 1888 a group of armed and masked Democrats stole a ballot box from a small town in Conway County, Arkansas. The box contained most of the county’s black Republican votes, thereby assuring defeat for candidate John Clayton in a close race for the U.S. Congress. Days after he announced he would contest the election, a volley of buckshot ripped through Clayton’s hotel window, killing him instantly. Thus began a yet-to-be-solved, century-old mystery.

More than a description of this particular event, however, Who Killed John Clayton? traces patterns of political violence in this section of the South over a three-decade period. Using vivid courtroom-type detail, Barnes describes how violence was used to define and control the political system in the post-Reconstruction South and how this system in turn produced Jim Crow. Although white Unionists and freed blacks had joined under the banner of the Republican Party and gained the upper hand during Reconstruction, during these last decades of the nineteenth century conservative elites, first organized as the Ku Klux Klan and then as the revived Democratic Party, regained power—via such tactics as murdering political opponents, lynching blacks, and defrauding elections.

This important recounting of the struggle over political power will engage those interested in Southern and American history.

Fifty years ago, the concept of animal rights was almost unheard of and the animal protection movement lay
dormant. Even vegetarians were regarded as, at best, cranks and, at worst, dangerous critics of the social order. Yet the late 1960s and early 1970s were a formative time for the contemporary animal rights movement. One of the most important and influential intellectual moments for animal rights
occurred at this time at Oxford University among like-minded scholars who would become known as the Oxford Group.

The Oxford Group and the Emergence of Animal Rights is about this little known group--a loose friendship group of primarily postgraduate philosophy students who attended the University of Oxford for a short period of time in the late 1960s. The book traces the early development of the Oxford Group
and its influence on animal rights theory and activism. It also serves as a case study of how the emergence of important work and the development of new ideas can be explained, as well as how the intellectual development of participants in a friendship group is influenced by their participation in a
creative community. For example, would Peter Singer have written his landmark book Animal Liberation--or anything about animal ethics--without being exposed to the other members of the Oxford Group? How would the discipline of animal ethics differ if the group had not produced their edited
collection of articles, Animals, Men and Morals? Drawing on previously unpublished correspondence among and interviews with the surviving Oxford Group members, Robert Garner and Yewande Okuleye explore the social and political milieu in which the group formed to understand how such intellectual
movements coalesce.
