From the charter to the will to the court roll, the majority of the documents which have survived from later medieval England and Ireland, and medieval Europe in general, are legal in nature. Yet despite the fact that law played a prominent role in medieval society, legal history has long been a marginal subject within medieval studies both in Britain and North America. Much good work has been done in this field, but there is much still to do. This volume, a collection of essays in honour of Paul Brand, who has contributed perhaps more than any other historian to our understanding of the legal developments of later medieval England and Ireland, is intended to help fill this gap. The essays collected in this volume, which range from the twelfth to the sixteenth century, offer the latest research on a variety of topics within this field of inquiry. While some consider familiar topics, they do so from new angles, whether by exploring the underlying assumptions behind England’s adoption of trial by jury for crime or by assessing the financial aspects of the General Eyre, a core institution of jurisdiction in twelfth- and thirteenth-century England. Most, however, consider topics which have received little attention from scholars, from the significance of judges and lawyers smiling and laughing in the courtroom to the profits and perils of judicial office in English Ireland. Early medieval Ireland is remembered as the "Land of Saints and Scholars," due to the distinctive devotion to Christian faith and learning that permeated its culture. As early as the seventh century, however, questions were raised about Irish orthodoxy, primarily concerning Easter observances. Yet heresy trials did not occur in Ireland until significantly later, long after allegations of Irish apostasy from Christianity had sanctioned the English invasion of Ireland.

In The Templars, the Witch, and the Wild Irish, Maeve Brigid Callan analyzes Ireland's medieval heresy trials, which all occurred in the volatile fourteenth century. These include the celebrated case of Alice Kyteler and her associates, prosecuted by Richard de Ledrede, bishop of Ossory, in 1324. This trial marks the dawn of the "devil-worshipping witch" in European prosecutions, with Ireland an unexpected birthplace.

Callan divides Ireland’s heresy trials into three categories. In the first stand those of the Templars and Philip de Braybrook, whose trial derived from the Templars’, brought by their inquisitor against an old rival. Ledrede’s prosecutions, against Kyteler and other prominent Anglo-Irish colonists, constitute the second category. The trials of native Irishmen who fell victim to the sort of propaganda that justified the twelfth-century invasion and subsequent colonization of Ireland make up the third. Callan contends that Ireland’s trials resulted more from feuds than doctrinal deviance and reveal the range of relations between the English, the Irish, and the Anglo-Irish, and the church’s role in these relations; tensions within ecclesiastical hierarchy and between secular and spiritual authority; Ireland’s position within its broader European context; and political, cultural, ethnic, and gender concerns in the colony.

In Translating "Clergie", Claire Waters explores texts in French verse and prose from England and the Continent that respond to the educational imperative implicit in the Fourth Lateran Council's mandate that individuals be responsible for their own salvation. These texts return repeatedly to the moment of death and individual judgment to emphasize the importance of the process of teaching and to remind teacher and learner of their common fate.
The texts' focus on death was not solely a means of terrifying an audience but enabled lay learners to envision confrontations or conversations with dead friends, saints, or even God. Such dialogues at the point of death reinforced the importance of the dialogue between teacher and learner in life and are represented in such varied works as doctrinal handbooks, miracles of the Virgin Mary, retellings of the Harrowing of Hell, and even fabliaux—tales of wit and reversal—in which it is possible to argue one's way into Heaven. Lively stories that featured minstrels dicing with saints, friends returning from the dead, and thieves teaching the prophets offered a model for laypeople considering how to put their Christian learning into practice and perhaps to teach others.
Rather than being seen as a challenge to ecclesiastical authority, lay learning in these texts is depicted as hopeful, comic, and affectionate. By examining informal works of Christian instruction used outside institutional teaching contexts to convey the learning of the schools to the parishes, Waters shows how lay learners could assume the role of disciple or student in a way previously available only to monks or university scholars.
