Описание: Through close readings of a range of popular Hollywood speculative fiction films including The Dark Knight, Unbreakable, I, Robot and The Hobbit, Timothy Peters explores how fictional worlds, particularly those that ‘make strange’ the world of the viewer, can render visible and make explicit the otherwise opaque theologies of modern law. He illustrates that speculative cinema’s genres of estrangement provide a way for us to see and engage the theological concepts of modern law in our era of late capitalism, global empire and the crises of neoliberalism.

Автор: Emanuele Castrucci Название: On the Idea of Potency: Juridical and Theological Roots of the Western Cultural Tradition ISBN: 1474411843 ISBN-13(EAN): 9781474411844 Издательство: Bloomsbury Academic Рейтинг: Цена: 105600.00 T Наличие на складе: Невозможна поставка. Описание: A critique of the metaphysical concept of power and potency in the history of Western jurisprudence
Sweeping through the history of Western philosophy of law, Emanuele Castrucci deals with the metaphysical idea of potency as defined by Spinoza and Nietzsche, upsetting entrenched theories of jurisprudence.
Castrucci first addresses how the idea of potency can change the meaning of the power ascribed to an omnipotent God. This brings together classical Greek philosophy with Jewish biblical exegesis, which Castrucci links through the juncture of Christianity. He then relates potency to the classical philosophical tradition in Aristotle's Metaphysics and its Arabic interpretations, particularly Ibn Rushd's (Averro s). This leads us to the genesis of natural law theory in Western philosophy, from Augustine to Aquinas and from Duns Scotus to Ockham.
Moving on, Castrucci examines the inherently problematic concept of political theology, pitting Spinozan-Nietzschean potency against Kant and Enlightenment natural law to reveal the weaknesses inherent in the Enlightenment system. Finally, Castrucci applies the theories of Carl Schmitt to the philosophical rationalism of the Western tradition, showing us how it has failed to contain absolute power in a juridical sense.

Written by leading experts on Aquinas's theology, the essays in Reading John with St. Thomas Aquinas bear common witness to a central theological conviction: the tasks of biblical exegesis and speculative theology, though distinct, indwell and inform each other. As the first book-length study of the full breadth of Aquinas's Commentary on the Gospel of John, this work illuminates the way in which thinking systematically or speculatively about revelation flows from questions raised within biblical exegesis itself.
Like any medieval biblical commentator, Aquinas attempts to understand a biblical text not only in itself but also by appealing to parallel interpretive texts drawn from throughout the Bible as well as the accumulated insights of the Church Fathers. This method enables him to penetrate deeply into the thought of the Bible, recognizing that the biblical authors--speaking from within the context of Israel and the Church--raise questions that are theological and that belong to coherent speculative theological frameworks. The result is, in large part, a speculative theological commentary that is not imposed on the biblical texts but emerges from it.
The essays in Reading John with St. Thomas Aquinas seek to illumine the necessary conjunction of the inspired words of Scripture, exegetical commentary, and theological analysis. The volume is both a study of Aquinas's thought and an attempt to foster contemporary exegetical approaches that emphasize the need to interpret Scripture speculatively, through the historical lens of tradition.

In Legal Fictions, Karla FC Holloway both argues that U.S. racial identity is the creation of U.S. law and demonstrates how black authors of literary fiction have engaged with the law's constructions of race since the era of slavery. Exploring the resonance between U.S. literature and U.S. jurisprudence, Holloway reveals Toni Morrison's Beloved and Charles Johnson's Middle Passage as stories about personhood and property, David Bradley's The Chaneysville Incident and Ralph Ellison's Invisible Man as structured by evidence law, and Nella Larsen's Passing as intimately related to contract law. Holloway engages the intentional, contradictory, and capricious constructions of race embedded in the law with the same energy that she brings to her masterful interpretations of fiction by U.S. writers. Her readings shed new light on the many ways that black U.S. authors have reframed fundamental questions about racial identity, personhood, and the law from the nineteenth into the twenty-first centuries. Legal Fictions is a bold declaration that the black body is thoroughly bound by law and an unflinching look at the implications of that claim.

Описание: This book is the first comprehensive history and analysis of legal fictions in the common law. It examines their origins and development over the last 400 years and covers numerous legal domains from civil and criminal law to administrative and international law. It covers a wide range of British and American examples from corporate personhood and civil death to constructive eviction and the scintilla juris.Legal fictions have been a source of hostility, confusion, amusement, and fascination ever since British lawyers first turned their attention to the subject, in the early 17th century. The book presents a new theory of legal fictions, showing how certain doctrines take a distinctively artificial form that differentiates them from the routine artifice we see everywhere in the law. Whereas conventional accounts assert that falsity is the fiction’s essential requirement, Law’s Artifice shows that the fictions’ critics and defenders alike have always been drawn to examples that brazenly and ostentatiously present themselves as constructs, exhibiting a kind of artifice that includes falsehoods but is hardly limited to that category. Rather than attempting to establish criteria for deciding what qualifies as a legal fiction, this study seeks to understand why people perceive certain doctrines as fictional and how to make sense of the disagreement that sometimes arises. Doing so requires an understanding not only of legal history, but also of literary history and theory, philosophy of language, and aesthetics. Drawing on recent research in all of these fields, Law’s Artifice shows how concerns about legal fictions have persisted even as the contents of the category have changed over time.
