Описание: Voices in the Legal Archives in the French Colonial World: The King is Listening offers, through the contribution of thirteen original chapters, a sustained analysis of judicial practices and litigation during the first era of French overseas expansion. The overall goal of this volume is to elaborate a more sophisticated social history of colonialism by focusing largely on the eighteenth century, extending roughly from 1700 until the conclusion of the Age of Revolutions in the 1830s. By critically examining legal practices and litigation in the French colonial world, in both its Atlantic and Oceanic extensions, this volume of essays has sought to interrogate the naturalized equation between law and empire, an idea premised on the idea of law as a set of doctrines and codified procedures originating in the metropolis and then transmitted to the colonies. This book advances new approaches and methods in writing a history of the French empire, one which views state authority as more unstable and contested. Voices in the Legal Archives proposes to remedy the under-theorized state of France’s first colonial empire, as opposed to its post-1830 imperial expressions empire, which have garnered far more scholarly attention.This book will appeal to scholars of French history and the comparative history of European empires and colonialism.

Описание: The Indian uprisings (1857 58) against British rule in India represent an iconic period within the history of anti-colonial resistance. Numerous works have considered these historical events from British and Indian perspectives, but none have yet questioned how they were viewed by Britain s foremost colonial rival in India, the French. The French Colonial Imagination examines how the potential for Britain to lose its most lucrative colony at the hands its own colonial subjects allowed French writers to envisage a world freed from British dominance. The uprisings offered the attractive possibility that France could undergo a colonial revival in the wake of British defeat, thereby reversing the devastating losses inflicted upon France s former empire at the end of the Napoleonic Wars. Notable among these losses was Britain s decision (in the Treaty of 1814) to permanently reduce France s presence in India to five small trading posts scattered around the periphery of British territory. The extent to which to the French colonial imagination of the nineteenth century was shaped by the memories of such defeats forms a primary concern of this monograph. This investigation into French responses to the Indian uprisings reveals that French colonial discourse was determined as much by its visions of the colonized other, as by the dominance of their British rivals. Drawing from journalistic, historical, political, and fictional texts written during Louis Napoleon s Second Empire (1852 70) and in the early years of the Third Republic (1870 1944), The French Colonial Imagination shows how the uprisings gave French writers the opportunity to speak out against the rapacity of British colonialism and its treatment of the colonized Indian, while simultaneously constructing a competing colonial discourse that would justify further expansion in North Africa and South East Asia. Standing at a crossroads between the loss of Ancien Regime s empire and the Third Republic s ideological investment in overseas expansion, this understudied period of colonial history reveals the centrality of loss, fracture, and political emasculation as core preoccupations haunting the French colonial discourse in its quest to regain cultural and ideological ascendancy over its greatest political enemy.

In Sins against Nature Zeb Tortorici explores the prosecution of sex acts in colonial New Spain (present-day Mexico, Guatemala, the US Southwest, and the Philippines) to examine the multiple ways bodies and desires come to be textually recorded and archived. Drawing on the records from over three hundred criminal and Inquisition cases between 1530 and 1821, Tortorici shows how the secular and ecclesiastical courts deployed the term contra natura—against nature—to try those accused of sodomy, bestiality, masturbation, erotic religious visions, priestly solicitation of sex during confession, and other forms of "unnatural" sex. Archival traces of the visceral reactions of witnesses, the accused, colonial authorities, notaries, translators, and others in these records demonstrate the primacy of affect and its importance to the Spanish documentation and regulation of these sins against nature. In foregrounding the logic that dictated which crimes were recorded and how they are mediated through the colonial archive, Tortorici recasts Iberian Atlantic history through the prism of the unnatural while showing how archives destabilize the bodies, desires, and social categories on which the history of sexuality is based.

After a long and hard day at work, which had taken him to Larnaca, Antonios Triantafyllides, a leading lawyer recently appointed to the Cypriot government's Advisory Council, arrived at his Nicosia home in the cool evening of 12 January 1934, only to be shot by an unknown assailant. He died the next morning. Twelve months later, Stavros Christodoulou was charged, but acquitted of the murder. Considered political, the murder has been a taboo subject for Cypriot society and historians alike, and a cold case that nobody has seemingly taken any interest in solving let alone in exploring (at least publicly), that is, until now.

This book offers a theory on who was behind the assassination of Antonios Triantafyllides, the FIRST attempt to break open and explain an 87-year-old cold case.In doing so, it explores both the relationship between the British colonial authorities and the Cypriot political elites, and the various divisions within the latter. Triantafyllides supported enosis, the union of Cyprus with Greece, but after over a decade of involvement in nationalist politics without results, he decided that the only way to achieve it was to cooperate with the British. This change occurred by the 1931 crisis, which culminated in the burning of the government house in Nicosia in October and led to a British crackdown, including the suspension of the constitution, abolition of the Legislative Council and the deporting of leading nationalists. In October 1933, the British decided to establish an Advisory Council of leading Cypriots. Triantafyllides, who had, albeit briefly, served in the elected Legislative Council and the nominated Executive Council, accepted the invitation. He attended one meeting before being shot. The British initially suspected the extreme nationalists and banished five of them, then blamed a communist conspiracy, but the man charged was acquitted.

This book creates and analyses a 'community of records' to show that by reading both with and especially against the grain, it is probable that those responsible were radical right-wing nationalist extremists. Thus, for historical criminologists and crime investigators, the exploration of the sources examined could serve as a model of forensic analysis of cold cases. For those interested in the British Empire, the book shows how the British authorities had no real control over extremist nationalist politics and political violence in the 1930s no more than they did in the 1950s, and they were unable to protect those individuals willing to work with them to better the country. In fact, as numerous historians have attested, during the campaign by EOKA between April 1955 and March 1959, more Greek Cypriot civilians were murdered than any other target group. For those with an interest in Cypriot history, this book will make startling and uncomfortable revelations about the so-called National Liberation Movement in Cyprus and suggest that the violence that gripped the island from the 1950s and led to partition could have been avoided had not for the assassination of arguably the most capable and astute politician produced, at least until that time, in the island.
