During more than a century of colonial rule over Algeria, the French state shaped and reshaped the meaning and practice of Muslim law by regulating it and circumscribing it to the domain of family law, while applying the French Civil Code to appropriate the property of Algerians. In Sex, Law, and Sovereignty in French Algeria, 1830–1930, Judith Surkis traces how colonial authorities constructed Muslim legal difference and used it to deny Algerian Muslims full citizenship. In disconnecting Muslim law from property rights, French officials increasingly attached it to the bodies, beliefs, and personhood.

Surkis argues that powerful affective attachments to the intimate life of the family and fantasies about Algerian women and the sexual prerogatives of Muslim men, supposedly codified in the practices of polygamy and child marriage, shaped French theories and regulatory practices of Muslim law in fundamental and lasting ways. Women's legal status in particular came to represent the dense relationship between sex and sovereignty in the colony. This book also highlights the ways in which Algerians interacted with and responded to colonial law. Ultimately, this sweeping legal genealogy of French Algeria elucidates how "the Muslim question" in France became—and remains—a question of sex.

Описание: In 1962 when Algeria finally obtained its independence from France after an eight-year guerilla war, it immediately embarked upon a second revolution aimed at destroying the colonial economic and social order. While the nationalist leaders struggled for power in the first hours of independence, peasants seized French farms and workers the factories, thus setting Algeria on the road toward a new socialist order. This book is a study of the Algerian socialist revolution, of those who made it and those who gained by it. The primary focus is on political behavior, on those aspects of the struggle among Algerian leader which vitally affected the character of the new order. The authors find that even though Algeria acquired all the trappings of a socialist state and economy, politics remained almost exclusively a question of personal relations, alliances, and rivalries among a small group of leaders--what the authors call, borrowing a concept from the fourteenth-century Arab historian Ibn Khaldun, the politics of assabiya. Algeria's first President, Ahmed Ben Bella, tried to integrate the new and old political groups into a modern political system, but he failed. His overthrow by the army opened a second phase in the process of building stable political institutions and of overcoming the tradition of "palace conspiracies and rebellions of feudal lords." The authors trace in details this cyclical process during the first six years of Alergian independence. The work benefits from a wealth of first-hand information gathered during the authors' three-year stay in the country. The resulting picture is that of a new nation embarked upon a socialist "revolution" which owes little to Soviet or Chinese influences or, in some respects, even to the intentions of its leaders. In 1830, with France's colonial empire in ruins, Charles X ordered his army to invade Ottoman Algiers. Victory did not salvage his regime from revolution, but it began the French conquest of Algeria, which was continued and consolidated by the succeeding July Monarchy. In By Sword and Plow, Jennifer E. Sessions explains why France chose first to conquer Algeria and then to transform it into its only large-scale settler colony. Deftly reconstructing the political culture of mid-nineteenth-century France, she also sheds light on policies whose long-term consequences remain a source of social, cultural, and political tensions in France and its former colony.

In Sessions's view, French expansion in North Africa was rooted in contests over sovereignty and male citizenship in the wake of the Atlantic revolutions of the eighteenth century. The French monarchy embraced warfare as a means to legitimize new forms of rule, incorporating the Algerian army into royal iconography and public festivals. Colorful broadsides, songs, and plays depicted the men of the Arm?e d'Afrique as citizen soldiers. Social reformers and colonial theorists formulated plans to settle Algeria with European emigrants. The propaganda used to recruit settlers featured imagery celebrating Algeria's agricultural potential, but the male emigrants who responded were primarily poor, urban laborers who saw the colony as a place to exercise what they saw as their right to work. Generously illustrated with examples of this imperialist iconography, Sessions's work connects a wide-ranging culture of empire to specific policies of colonization during a pivotal period in the genesis of modern France.
