Описание: Proportionality is a German, and thus continental European, concept in public law that is applied by both the Court of Justice of the European Union (CJEU) and the European Court of Human Rights (ECtHR). The principle specifies that measures adopted by executive authorities should not exceed the limits of what is appropriate and necessary in order to achieve legitimate objectives in the interest of the public. Using a functional comparative approach, this book evaluates the extent to which proportionality has been integrated into the English and Hong Kong judicial systems by comparing case law in these courts with that of the CJEU and the ECtHR. The text also reviews the development of proportionality and presents a topical understanding of why its adoption and application have encountered difficulties in some jurisdictions, such as the United Kingdom and Hong Kong. Written by a scholar with experience from both within the Hong Kong judicial system and from international research, this book is the first all-encompassing reference for legal practitioners. With its exploration of alternatives to proportionality and particular cases where issues of proportionality have arisen, this text is highly relevant in legal climates worldwide.

A comprehensive examination of developmental inequality among children
Developmental equality-whether every child has an equal opportunity to reach their fullest potential-is essential for children's future growth and access to opportunity. In the United States, however, children of color are disproportionately affected by poverty, poor educational outcomes, and structural discrimination, limiting their potential. In Reimagining Equality, Nancy E. Dowd sets out to examine the roots of these inequalities by tracing the life course of black boys from birth to age 18 in an effort to create an affirmative system of rights and support for all children.
Drawing on interdisciplinary research, the book demonstrates that black boys encounter challenges and barriers that funnel them toward failure rather than developmental success. Their example exposes a broader reality of hierarchies among children, linked to government policies, practices, structures, and institutions. Dowd argues for a new legal model of developmental equality, grounded in the real challenges that children face on the basis of race, gender, and class.
Concluding with a "New Deal" for all children, Reimagining Equality provides a comprehensive set of policies that enables our political and legal systems to dismantle what harms and discriminates children, and maximize their development.

Описание: More than 50 years after re Gault revolutionized the US juvenile court system, this book examines how the reformed system has evolved.
Over the last few decades, the racial and ethnic composition of the United States has changed dramatically. This seismic transformation has important implications for theory, research, policy, and public opinion - perhaps most crucially around the topic of race/ethnicity and our justice systems. Recent national events - from Ferguson, to ferocious public debate about racism, to media depictions of police violence - have reawakened the tense question of race relations in the 21st century. This edited collection of research aims to highlight contemporary issues surrounding the overrepresentation of racial and ethnic minorities throughout both the juvenile and adult criminal justice systems. Our contributors cover both formal sources of social control (e.g. police, courts, correction facilities) and perceptions and public opinions of the relationship between race/ethnicity and offending behaviors. As the intellectual sphere ignites with fresh debate, old questions redefined and new ones asked, this publication provides innovative insight into how race and ethnicity interconnect with all aspects of criminology and criminal justice. Furthermore it helps encourage directions for future research, practice, and public policy. This book was originally published as a special issue of the Journal of Crime and Justice.

Описание: The anthology A Critical Analysis of Race and the Administration of Justice offers historical and contemporary perspectives on critical issues in the administration of justice and places these issues within a variety of theoretical and sociological contexts. The book focuses on each stage of the criminal justice system—police, courts, and corrections—and examines the way justice is administered differently to certain groups within the overall population. A Critical Analysis of Race and the Administration of Justice begins with a piece written in 1941 that explores the ways in which societal responses to crime were influenced by abuses of police powers and differential treatment of African-Americans in the court system. As the reading selections progress through the next seventy years and more, students will learn about contemporary race and justice topics such as public opinion, sentencing and youth incarceration. Designed to encourage critical thinking and stimulate dialogue, A Critical Analysis of Race and the Administration of Justice, is ideal for introductory criminal justice classes, and those that deal with issues of race, gender, and crime.

Описание:
The murder of unarmed teenager Trayvon Martin and the subsequent trial and acquittal of his assailant, George Zimmerman, sparked a passionate national debate about race and criminal justice in America that involved everyone from bloggers to mayoral candidates to President Obama himself. With increased attention to these causes, from St. Louis to Los Angeles, intense outrage at New York City’s Stop and Frisk program and escalating anger over the effect of mass incarceration on the nation’s African American community, the Trayvon Martin case brought the racialized nature of the American justice system to the forefront of our national consciousness. Deadly Injustice uses the Martin/Zimmerman case as a springboard to examine race, crime, and justice in our current criminal justice system. Contributors explore how race and racism informs how Americans think about criminality, how crimes are investigated and prosecuted, and how the media interprets and reports on crime. At the center of their analysis sit examples of the Zimmerman trial and Florida’s controversial Stand Your Ground law, providing current and resonant examples for readers as they work through the bigger-picture problems plaguing the American justice system. This important volume demonstrates how highly publicized criminal cases go on to shape public views about offenders, the criminal process, and justice more generally, perpetuating the same unjust cycle for future generations. A timely, well-argued collection, Deadly Injustice is an illuminating, headline-driven text perfect for students and scholars of criminology and an important contribution to the discussion of race and crime in America.
At the start of the twenty-first century, 1 percent of the U.S. population is behind bars. An additional 3 percent is on parole or probation. In all but two states, incarcerated felons cannot vote, and in three states felon disenfranchisement is for life. More than 5 million adult Americans cannot vote because of a felony-class criminal conviction, meaning that more than 2 percent of otherwise eligible voters are stripped of their political rights. Nationally, fully a third of the disenfranchised are African American, effectively disenfranchising 8 percent of all African Americans in the United States. In Alabama, Kentucky, and Florida, one in every five adult African Americans cannot vote. Punishment and Inclusion gives a theoretical and historical account of this pernicious practice of felon disenfranchisement, drawing widely on early modern political philosophy, continental and postcolonial political thought, critical race theory, feminist philosophy, disability theory, critical legal studies, and archival research into state constitutional conventions. It demonstrates that the history of felon disenfranchisement, rooted in postslavery restrictions on suffrage and the contemporaneous emergence of the modern “American” penal system, reveals the deep connections between two political institutions often thought to be separate, showing the work of membership done by the criminal punishment system and the work of punishment done by the electoral franchise. Felon disenfranchisement is a symptom of the tension that persists in democratic politics between membership and punishment. This book shows how this tension is managed via the persistence of white supremacy in contemporary regimes of punishment and governance.
