Описание: A follow-up to Claiming Anishinaabe, Gehl v Canada is the story of Lynn Gehls lifelong journey of survival against the nation-states constant genocidal assault against her existence. While Canada set up its colonial powers—including the Supreme Court, House of Commons, Senate Chamber, and the Residences of the Prime Minister and Governor General—on her traditional Algonquin territory, usurping the riches and resources of the land, she was pushed to the margins, exiled to a life of poverty in Torontos inner-city. With only beads in her pocket, Gehl spent her entire life fighting back, and now offers an insider analysis of Indian Act litigation, the narrow remedies the court imposes, and of obfuscating parliamentary discourse, as well as an important critique of the methodology of legal positivism. Drawing on social identity and Indigenous theories, the author presents Disenfranchised Spirit Theory, revealing insights into the identity struggles facing Indigenous Peoples to this day.

Описание: Migrant workers, though long welcomed in Canada for their labour, are often excluded from both workplace protections and basic social benefits such as health care, income assistance, and education. Through interviews with migrants and their advocates, Marsden shows that people with precarious migration status face barriers in law, policy, and practice, affecting their ability to address adverse working conditions and their access to institutions such as hospitals, schools, and employment standards boards. Enforcing Exclusion recasts what migration status means to both the state and to non-citizens, questioning the adequacy of human-rights-based responses in addressing its exclusionary effects.

Описание: Common wisdom suggests that 9/11 changed everything about refugee law in the United States and Canada. But did it? Refugee Law after 9/11 systematically examines the evidence to reveal that refugee rights were already so whittled down in both countries before 9/11 that there was relatively little room for negative change after the attacks. It also shows that the Canadian refugee law regime reacted to 9/11 in much the same way as its US counterpart, and these similar reactions raise significant questions about security relativism and national self-image in the two countries.

Описание: Women have reached the highest levels of political office in Canada’s provinces and territories, but what difference has their rise to the top made? In Doing Politics Differently? leading researchers from across the country assess the track records of eleven premiers, including their impact on policies of particular interest to women and their influence on the tenor of legislative debate and the recruitment of other women as party candidates, cabinet ministers, and senior bureaucrats. By comparing the performance of women leaders and then contrasting it with the men who preceded and succeeded them, this innovative volume probes the importance of demographic diversity in top public office using a variety of powerful analytic lenses.

Описание: For indigenous communities throughout the globe, mining has been a historical forerunner of colonialism, introducing new, and often disruptive, settlement patterns and economic arrangements. Although indigenous communities may benefit from and adapt to the wage labour and training opportunities provided by new mining operations, they are also often left to navigate the complicated process of remediating the long-term ecological changes associated with industrial mining. In this regard, the mining often inscribes colonialism as a broad set of physical and ecological changes to indigenous lands.

Mining and Communities in Northern Canada examines historical and contemporary social, economic, and environmental impacts of mining on Aboriginal communities in northern Canada. Combining oral history research with intensive archival study, this work juxtaposes the perspectives of government and industry with the perspectives of local communities. The oral history and ethnographic material provides an extremely significant record of local Aboriginal perspectives on histories of mining and development in their regions.

Описание: “I was the only woman.” These words appear again and again in the stories of women planners working in Canada from the 1940s to the 1970s. Despite their small numbers, women were active in the Community Planning Association of Canada and the Town Planning Institute of Canada (later called the Canadian Institute of Planners) during those years. This book tells their stories, expanding our understanding of what constitutes “planning” and who counts as “planners.” It challenges us to re-evaluate not only the profession’s past, but also its role in creating a more inclusive and equitable future.

Описание: Established narratives portray Indigenous unity as emerging solely in response to the political agenda of the settler state. But unity has long shaped the modern Indigenous political movement. With Indigenous perspectives in the foreground, Assembling Unity explores the relationship between global political ideologies and pan-Indigenous politics in British Columbia through a detailed history of the Union of BC Indian Chiefs. Sarah Nickel demonstrates that the articulation of unity was heavily negotiated between UBCIC members, grassroots constituents, and Indigenous women’s organizations. This incisive work unsettles dominant political narratives that cast Indigenous men as reactive and Indigenous women as apolitical.

Описание: In Daniels v. Canada the Supreme Court determined that M?tis and non-status Indians were 'Indians' under section 91(24) of the Constitution Act, 1867, one of a number of court victories that has powerfully shaped M?tis relationships with the federal government. However, the decision (and the case) continues to reverberate far beyond its immediate policy implications. Bringing together scholars and practitioners from a wide array of professional contexts, this volume demonstrates the power of Supreme Court of Canada cases to directly and indirectly shape our conversations about and conceptions of what Indigeneity is, what its boundaries are, and what Canadians believe Indigenous peoples are 'owed.' Attention to Daniels v. Canada's variegated impacts also demonstrates the extent to which the power of the courts extend and refract far deeper and into a much wider array of social arenas than we often give them credit for. This volume demonstrates the importance of understanding 'law' beyond its jurisprudential manifestations, but it also points to the central importance of respecting the power of court cases in how law is carried out in a liberal nation-state such as Canada.

Описание: Guatemala emerged from the clash between Spanish invaders and Maya cultures that began five centuries ago. The conquest of these 'rich and strange lands,' as Hern?n Cort?s called them, and their 'many different peoples' was brutal and prolonged. 'Strange Lands and Different Peoples' examines the myriad ramifications of Spanish intrusion, especially Maya resistance to it and the changes that took place in native life because of it. The studies assembled here, focusing on the first century of colonial rule (1524-1624), discuss issues of conquest and resistance, settlement and colonization, labor and tribute, and Maya survival in the wake of Spanish invasion. The authors reappraise the complex relationship between Spaniards and Indians, which was marked from the outset by mutual feelings of resentment and mistrust. While acknowledging the pivotal role of native agency, the authors also document the excesses of Spanish exploitation and the devastating impact of epidemic disease. Drawing on research findings in Spanish and Guatemalan archives, they offer fresh insight into the Kaqchikel Maya uprising of 1524, showing that despite strategic resistance, colonization imposed a burden on the indigenous population more onerous than previously thought. Guatemala remains a deeply divided and unjust society, a country whose current condition can be understood only in light of the colonial experiences that forged it. Affording readers a critical perspective on how Guatemala came to be, 'Strange Lands and Different Peoples' shows the events of the past to have enduring contemporary relevance.

Описание: Reclaiming Tom Longboat recounts the history of Indigenous sport in Canada through the lens of the prestigious Tom Longboat Awards, shedding light on a significant yet overlooked aspect of Canadian policy and Crown-Indigenous relations. Drawing on a rich and varied set of oral and textual sources, including interviews with award recipients and Jan Eisenhardt, the creator of the Awards himself, Janice Forsyth critically assesses the states role in policing Indigenous bodies and identities through sport, from the assimilationist sporting regulations of residential schools to the present-day exclusion of Indigenous activities from mainstream sports. This work recognizes the role of sport as a tool for colonization in Canada, while also acknowledging its potential to become a tool for decolonization and self-determination. "Through considering the Awards in the broader context of ongoing colonial relations in Canada, and bringing to light the voices of the recipients, this study extends well beyond the Tom Longboat Awards history to encompass the complicated place of sport in the Indigenous experience." —Robert Kossuth, Associate Professor of Kinesiology and Physical Education, University of Lethbridge

Описание: For decades, the Chinese Rescue Home was a feature of the landscape of Victoria, British Columbia. Originally a refuge for Chinese prostitutes and slave girls rescued from captivity, it became a residence and school where the Methodist Women’s Missionary Society attempted to reform Chinese and Japanese girls and women. They did so, in part, by teaching them domestic skills meant to ease their integration into Western society. This book offers the first in-depth history and analysis of this iconic institution and expands our understanding of the complex interplay between gender, race, and class in BC during this time.
