Описание: Against Capital Punishment develops an innovative argument against the death penalty that sidesteps questions about the morality of execution itself. Yost argues that the irrevocability of the death penalty calls for its abolition. In so doing, he explores the extent of legal institutions` responsibility to remedy their mistakes and solves the problems that sabotage other versions of procedural abolitionism
The central aim of this book is to approach contemporary problems raised by technologies of life and death as ethical issues that call for a more nuanced approach than mainstream philosophy can provide. To do so, it draws on the recently published seminars of Jacques Derrida to analyze the extremes of birth and dying insofar as they are mediated by technologies of life and death. With an eye to reproductive technologies, it shows how a deconstructive approach can change the very terms of contemporary debates over technologies of life and death, from cloning to surrogate motherhood to capital punishment, particularly insofar as most current discussions assume some notion of a liberal individual. The ethical stakes in these debates are never far from political concerns such as enfranchisement, citizenship, oppression, racism, sexism, and the public policies that normalize them. Technologies of Life and Death thus provides pointers for rethinking dominant philosophical and popular assumptions about nature and nurture, chance and necessity, masculine and feminine, human and animal, and what it means to be a mother or a father. In part, the book seeks to disarticulate a tension between ethics and politics that runs through these issues in order to suggest a more ethical politics by turning the force of sovereign violence back against itself. In the end, it proposes that deconstructive ethics with a psychoanalytic supplement can provide a corrective for moral codes and political clich?s that turn us into mere answering machines.

Описание: Focusing contemporary democratic theory on the neglected topic of punishment, Punishment, Participatory Democracy, and the Jury argues for increased civic engagement in criminal justice as an antidote to the American penal state. Albert W. Dzur considers how the jury, rather than merely expressing unreflective public opinion, may serve as a participatory institution that gathers and utilizes citizens' juridical capabilities. In doing so, the book resists trends in criminal justice scholarship that blame increases in penal severity on citizen participation and rejects political theorists' longstanding skepticism of lay abilities. Dzur distinguishes constructive citizen involvement that takes responsibility for public problems from a mass politics mobilized superficially around single issues. This more positive view of citizen action, which was once a major justification for the jury trial, is now also manifest in the restorative justice movement, which has incorporated lay people into community boards and sentencing circles. Both jury trials and restorative justice programs, Dzur explains, are examples of rational disorganization, in which lay citizen action renders a process less efficient yet also contributes valuable qualities such as attunement, reflectiveness, and full-bodied communication. While restorative justice programs and participatory policy forums such as citizens' juries have become attractive to reformers, traditional juries have suffered a steep and troubling decline. Punishment, Participatory Democracy, and the Jury advocates a broader role for jurors in the criminal courts and more widespread use of jury trials. Though no panacea for a political culture grown too comfortable with criminalization and incarceration, participatory institutional designs that rationally disorganize punishment practices and slow down criminal justice can catalyze civic responsibility and public awareness about the need to find alternative paths forward for America's broken penal system.

Описание: In Playing Fair, Richard Dagger provides a unified theory of political obligation and the justification of punishment that takes its bearings from the principle of fair play. Dagger argues that members of a just polity have an obligation to obey its laws because they have an obligation of reciprocity or fair play to one another.

Описание: Philosophers, legal scholars, criminologists, psychiatrists, and psychologists have long asked important questions about punishment: What is its purpose? What theories help us better understand its nature? Is punishment just? Are there effective alternatives to punishment? How can empirical data from the sciences help us better understand punishment? What are the relationships between punishment and our biology, psychology, and social environment? How is punishment understood and administered differently in different societies? The Routledge Handbook of the Philosophy and Science of Punishment is the first major reference work to address these and other important questions in detail, offering 31 chapters from an international and interdisciplinary team of experts in a single, comprehensive volume. It covers the major theoretical approaches to punishment and its alternatives; emerging research from biology, psychology, and social neuroscience; and important special issues like the side-effects of punishment and solitary confinement, racism and stigmatization, the risk and protective factors for antisocial behavior, and victims' rights and needs. The Handbook is conveniently organized into four sections:I. Theories of Punishment and Contemporary PerspectivesII. Philosophical Perspectives on PunishmentIII. Sciences, Prevention, and PunishmentIV.
