Описание:

Based on extensive field research, the essays in this volume illuminate the experiences of migrants from their own point of view, providing a critical understanding of the complex social reality in which each experience is grounded. Access to medical care for migrants is a fundamental right which is often ignored. The book provides a critical understanding of the social reality in which social inequalities are grounded and offers the opportunity to show that right to health does not correspond uniquely with access to healthcare.

Описание: At a time when states are increasingly hostile to the international rights regime, human rights activists have turned to non-state and sub-state actors to begin the implementation of human rights law. This complicates the conventional analysis of relationships between local actors, global norms, and cosmopolitanism. The contributions in this open access collection examine the “lived realities of human rights” and critically engage with debates on gender, sexuality, localism and cosmopolitanism, weaving insights from multiple disciplines into a broader call for interdisciplinary scholarship informed by practice. Overall, the contributors argue that the power of human rights depends on their ability to be continuously broadened and re-imagined in locales around the world. It is only on this basis that human rights can remain relevant and be effectively used to push local, national and international institutions to put in place structural reforms that advance equity and pluralism in these perilous times. The eBook editions of this book are available open access under a CC BY-NC-ND 4.0 licence on bloomsburycollections.com.

Описание: The civil justice system is characterized by a distinct dispute resolution and law enforcement functions, although these functions are not always explicit and their relationship can be vague. People normally turn to this legal system to address an ""unjust"" situation they encounter. This makes civil justice both socially and economically important, as it may be driven by efficiency or access to justice concerns. The literature suggests that law reform has an uninspiring record in this field. This is because it has, largely, not been considered with a detailed, empirically informed evaluation of proposed solutions. This legal system is complex, and research in this field is correspondingly challenging, interesting, and important.

The Handbook of Research on Civil Justice provides significant empirical research findings as well as theoretical reviews and frameworks on a wide array of issues within civil justice and the legal system. This includes topic areas such as access to justice and legal representation, the challenges to developing civil justice, courts and procedures, and civil justice reform. This book is valuable for lawyers, human rights lawyers, court officials, psychologists, social workers, sociologists, consultants, professionals, academicians, students, and researchers working in the field of law, socio-legal studies, sociology, anthropology, political science, social work, social policy, economics, and criminal justice, along with anyone seeking updated information on the current reforms and challenges within the civil justice and legal systems.

Campaigning for Children: Strategies for Advancing Children`s Rights

Описание:

Advocates within the growing field of children's rights have designed dynamic campaigns to protect and promote children's rights. This expanding body of international law and jurisprudence, however, lacks a core text that provides an up-to-date look at current children's rights issues, the evolution of children's rights law, and the efficacy of efforts to protect children.

Campaigning for Children focuses on contemporary children's rights, identifying the range of abuses that affect children today, including early marriage, female genital mutilation, child labor, child sex tourism, corporal punishment, the impact of armed conflict, and access to education. Jo Becker traces the last 25 years of the children's rights movement, including the evolution of international laws and standards to protect children from abuse and exploitation. From a practitioner's perspective, Becker provides readers with careful case studies of the organizations and campaigns that are making a difference in the lives of children, and the relevant strategies that have been successful—or not. By presenting a variety of approaches to deal with each issue, this book carefully teases out broader lessons for effective social change in the field of children's rights.

Описание: Human rights come into question in times of crisis. But should we wait for crises to arise before we discuss these rights? Advancing human rights should be everyones business, not just that of a select group of public interest lawyers, conspiracy theorists or those who prefer tinfoil hats. Human rights are routinely debated in the wake of scandals. Think about the quality of care in nursing homes, the treatment of illegal immigrants, and police practices towards Indigenous people in custody--all examples of crises that demand remedies and receive less than satisfactory solutions. Our rights certainly became an issue of heated public debate during the COVID-19 pandemic. Michael Mintrom argues that the advancement of human rights is an investment: our efforts today will create ongoing benefits for society. He finds the answers in enhancing the quality and accessibility of early childhood education, shutting down the school-to-prison pipeline, and assisting former prisoners during their re-entry into society. Beyond these powerful examples, he also suggests other candidates for policy change that will lead to the progression of human rights. In a caring society, the question of how to advance human rights should lie at the heart of public policymaking. But does our political class have the will to make the changes needed to ensure a fairer and more just society?

Описание:

The Universal Declaration of Human Rights is one of the world's best-known and most translated documents. When it was presented to the United Nations General Assembly in December in 1948, Eleanor Roosevelt, chair of the writing group, called it a new "Magna Carta for all mankind." The passage of time has shown Roosevelt to have been largely correct in her prediction as to the declaration's importance. No other document in the world today can claim a comparable standing in the international community.
Roosevelt and French legal expert René Cassin have often been represented as the principal authors of the declaration. But in fact, it resulted from a collaborative effort involving a number of individuals in different capacities. One of the declaration's most important authors was the vice chairman of the Human Rights Commission, Peng Chun Chang (1892-1957), a Chinese diplomat and philosopher whose contribution has been the focus of growing attention in recent years. Indeed, it is Chang who deserves the credit for the universality and religious ecumenism that are now regarded as the declaration's defining features. Despite this, Chang's extraordinary contribution has been overlooked by historians.
Peng Chun Chang was a modern-day Renaissance man—teacher, scholar, university chancellor, playwright, diplomat, and politician. A true cosmopolitan, he was deeply involved in the cultural exchange between East and West, and the dramatic events of his life left a profound mark on his intellectual and political work. P. C. Chang and the Universal Declaration of Human Rights is the first biography of this extraordinary actor on the world stage, who belonged to the same generation as Mao Zedong and Chiang Kai-shek. Drawing on previously unknown sources, it casts new light on Chang's multifaceted life and involvement with one of modern history's most important documents.
