The Annals of the American Academy of Political and Social Science: The Rise of the Regulatory Welfare State: The Use and Abuse of Social Regulation, Benish Avishai, Levi-Faur David
A groundbreaking account of how the welfare state began with early nineteenth-century child labor laws, and how middle-class and elite reformers made it happen
The beginnings of the modern welfare state are often traced to the late nineteenth-century labor movement and to policymakers' efforts to appeal to working-class voters. But in Agents of Reform, Elisabeth Anderson shows that the regulatory welfare state began a half century earlier, in the 1830s, with the passage of the first child labor laws. Agents of Reform tells the story of how middle-class and elite reformers in Europe and the United States defined child labor as a threat to social order, and took the lead in bringing regulatory welfare into being. They built alliances to maneuver around powerful political blocks and instituted pathbreaking new employment protections. Later in the century, now with the help of organized labor, they created factory inspectorates to strengthen and routinize the state's capacity to intervene in industrial working conditions. Agents of Reform compares seven in-depth case studies of key policy episodes in Germany, France, Belgium, Massachusetts, and Illinois. Foregrounding the agency of individual reformers, it challenges existing explanations of welfare state development and advances a new pragmatist field theory of institutional change. In doing so, it moves beyond standard narratives of interests and institutions toward an integrated understanding of how these interact with political actors' ideas and coalition-building strategies.

Описание: Across the world the prevailing narrative has become one of Good Governance, devolution, liberation, and freedom of expression. In policy fields as diverse as development planning, healthcare, and public transport a neo-pluralist rhetoric has emerged based on the principles of `co-production` and partnership working.

Описание: This book demonstrates that the American institutional combination of common law and the presidential system favored policy implementation through formal procedures by autonomous agencies, and that it induced the creation and development of independent regulatory commissions explicitly modeled after courts from the late nineteenth century.
By reviewing regulatory initiatives in health financing, service provision, pharmaceutical sector and public health, this book attempts to connect recent research with policy developments in the Chinese health-care system. While there are a small number of studies on the regulations in the Chinese health-care system, this book contributes to the literature in three ways. First, a review of the recent developments in the Chinese health-care system illustrates that the capacity and incentives of the regulatory agencies matter in the implementation and enforcement of the regulations. Second, this book also shows that some institutional arrangements in the Chinese context are particularly important for configuring the capacity and incentives of the regulatory system. Third, this book lays out the mechanisms for the regulatory reform of the Chinese health-care system.

Описание: The Regulatory Flexibility Act of 1980 established a process of analysing and mitigating impacts of federal regulations on small businesses and other small entities. In the ensuing years, states began adopting regulatory flexibility legislation (or executive orders) of their own. In 2002 the SBA Office of Advocacy launched a Model Legislation Initiative utilising a model state regulatory flexibility bill, which incorporated many elements of the federal legislation in simplified form. The model legislation was published for general use in 2005, along with supporting commentary and materials, and a guidance document to assist states in implementing regulatory flexibility legislation was published in 2007. About half the states adopted regulatory flexibility legislation in the period 2002-2007. By the end of this period, the SBA data showed that 45 states and territories had some form of regulatory flexibility legislation or executive order, and about 20 of those included all of the elements in the model legislation. SBAs Model Legislation Initiative wound down at the end of the Bush administration, although progress continued at the state level. This book examines regulatory flexibility at the state level with two general purposes: to assess the implementation of state regulatory flexibility laws; and to document further developments of state regulatory flexibility programs. The book draws on available public documents and examines the legislation of each state and traces the rule-making process from notice through regulatory flexibility analysis and review.

Описание: This book presents an alternative theoretical approach to the study of the transformation of the modern welfare state. In so doing, it seeks to integrate French regulation theory and British state theory within the broader framework of discourse analysis.
