This sweeping book details the extent to which the legal revolution emanating from the US has transformed legal hierarchies of power across the globe, while also analyzing the conjoined global histories of law and social change from the Middle Ages to today. It examines the global proliferation of large corporate law firms--a US invention--along with US legal education approaches geared toward those corporate law firms. This neoliberal-inspired revolution attacks complacent legal oligarchies in the name of America-inspired modernism. Drawing on the combined histories of the legal profession, imperial transformations, and the enduring and conservative role of cosmopolitan elites at the top of legal hierarchies, the book details case studies in India, Hong Kong, South Korea, Japan, and China to explain how interconnected legal histories are stories of both revolution and reproduction. Theoretically and methodologically ambitious, it offers a wholly new approach to studying interrelated fields across time and geographies.

Описание: The capacity of a society to anticipate, pre-empt and resolve disruptive challenges to its vital functions has become a high priority for many countries across the Atlantic and around the world. But is resilience enough to deal with disruptive threats in a deeply interconnected world? In this volume, eminent authors argue that state-by-state approaches to resilience are insufficient. Not only must resilience be shared, it must be projected forward, and traditional notions of territorial security must be supplemented with actions to address flow security- protecting critical links tha bind societies to one another. Authors include: Robert Bach, Alyson JK Bailes, Hans Binnendijk, Charlotta Collen, Bjorn Fagersten, Axel Hagelstam, Daniel S. Hamilton, Tomas Jermalavicius, David J. Kaufman, Lorenz Meyer- Minnemann, Piret Pernik, Tim Prior, Mark Rhinard, Tomas Ries, Bengt Sundelius and Anna Wieslander.

Описание: A globalized world places new demands on us as citizens. Global Citizen—Challenges and Responsibility in an Interconnected World gives insight and perspectives on what it means to be a citizen in a global world from Norway’s most distinguished scholars. It poses and answers important questions, such as which duties and rights do we have as citizens in a globalized world; which institutions are just and sustainable, and how can a global ethic and a global worldview be reconciled with the fact that the lives of the greater part of the Earth’s population is still local? Global Citizen—Challenges and Responsibility in an Interconnected World draws on insights from philosophy, jurisprudence, theology, and the social sciences to shed light on this manifold and important topic, with relevance for policy makers, stakeholders, academics, but most important, for us as citizens who need to take both a political and personal decision on how to live as a citizen in a global world.

Описание:

This monograph opens with an examination of the aid industry and the claims of leading practitioners that the industry is experiencing a crisis of confidence due to an absence of clear moral guidelines. The book then undertakes a critical review of the leading philosophical accounts of the duty to aid, including the narrow, instructive accounts in the writings of John Rawls and Peter Singer, and broad, disruptive accounts in the writings of Onora O’Neill and Amartya Sen. Through an elaboration of the elements of interconnection, responsible action, inclusive engagement, and accumulative duties, the comparative approach developed in the book has the potential to overcome the philosophical tensions between the accounts and provide guidance to aid practitioners, donors and recipients in the complex contemporary circumstances of assistance.Informed by real world examples, this book grapples with complex and multi-dimensional questions concerning practices and the ethics of aid. The author judiciously guides us through the debate between deontological and consequentialist moral theories to arrive at a sophisticated consequentialist account that does justice to the complexity of the problems and facilitates our deliberation in discharging our duty to aid, without yielding, as it should not, a determinate answer for each specific situation. Researchers, students, and practitioners of international aid will all find this book rewarding.Win-chiat Lee, Professor and Chair, Department of Philosophy, Wake Forest UniversitySusan Murphy’s book offers us a sophisticated exploration of the philosophical basis for aid. It is grounded in a full understanding of the complexities and pitfalls of the aid industry, but its particular strength lies, mainly through an extensive discussion of Singer, Rawls, O’Neill and Sen, in a comparison of consequentialist and duty-based approaches, eventually endorsing a broad non-idealised, situated consequentialist account in what she calls an interconnected ethical approach to the practice of assistance. For anyone wanting to think carefully about why we should give aid, this book has much to offer.Dr Nigel DowerHonorary Senior Lecturer, University of Aberdeen Author of World Ethics – the New Agenda (2007)
