Over the past two decades, human rights as legal doctrine and practice has shifted its engagement with criminal law from a near exclusive condemnation of it as a source of harm toward increasingly invoking it as a necessary remedy for abuses. These shifts are most visible in the context of sexuality, reproduction, and gender. Criminal law appears in modern states as a tool for societies to define forbidden acts (crimes) and prescribe punishments. It authorizes the state to use force as an aspect of expressing and establishing norms—societal expectations for acceptable behavior which when breached permit individuals to be excluded and stigmatized as unfit for inclusion. But the core principles of human rights oppose exclusion and stigma and embrace the equality and dignity of all. Therefore there is an insuperable tension when human rights actors invoke criminal law to protect and vindicate human rights violations. Beyond Virtue and Vice examines the ways in which recourse to the criminal law features in work by human rights advocates regarding sexuality, gender, and reproduction and presents a framework for considering if, when, and under what conditions, recourse to criminal law is compatible with human rights. Contributors from a wide range of disciplinary fields and geographic locations offer historical and contemporary perspectives, doctrinal cautionary tales, and close readings of advocacy campaigns on the use of criminal law in cases involving abortion and reproductive rights, HIV/AIDS, sex work and prostitution law, human trafficking, sexual violence across genders, child rights and adolescent sexuality, and LGBT issues. The volume offers specific values and approaches of possible use to advocates, activists, policy makers, legislators, scholars, and students in their efforts to craft dialogue and engagement to move beyond state practices that compromise human rights in the name of restraining vice and extolling virtue. From the celebrated historian of Nazi Germany, the story of a remarkable but completely unsung group that risked everything to help the most vulnerable
In the early 1920s amidst the upheaval of Weimar Germany, a small group of peaceable idealists began to meet, practicing a quiet, communal life focused on self-improvement. For the most part, they had come to know each other while attending adult education classes in the city of Essen. But "the Bund," as they called their group, had lofty aspirations--under the direction of their leader Artur Jacobs, its members hoped to forge an ideal community that would serve as a model for society at large. But with the ascent of the Nazis, the Bund was forced to reevaluate its mission, focusing instead on offering assistance to the persecuted, despite the great risk. Their activities ranged from visiting devastated Jewish families after Kristallnacht, to sending illicit letters and parcels of food and clothes to deportees in concentration camps, to sheltering political dissidents and Jews on the run.
What became of this group? And how should its deeds--often small, seemingly insignificant acts of kindness and assistance--be evaluated in the broader history of life under the Nazis? Drawing on a striking set of previously unpublished letters, diaries, Gestapo reports, other documents, and his own interviews with survivors, historian Mark Roseman shows how and why the Bund undertook its dangerous work. It is an extraordinary story in its own right, but Roseman takes us deeper, encouraging us to rethink the concepts of resistance and rescue under the Nazis, ideas too often hijacked by popular notions of individual heroism or political idealism. Above all, the Bund's story is one that sheds new light on what it meant to offer a helping hand in this dark time.

Описание: Two murders forty nine years apart against the background of a rising, fiery, mushroom cloud and unseen but poisonous dust whipped by wind moving miles from the blast site, the killing field extended as the clock ticks. That was yesterdays technology, merely a Model T. Against that tapestry will a courtroom be the forum to deliver justice?

On January 20, 1942, in a grand villa on the shore of Berlin's Lake Wannsee, a conference of Nazi officers produced a paper known as the Wannsee Protocol, which laid the groundwork for a final solution to the Jewish Question. This Protocol has always mystified us. How should we understand this calm, business-like discussion of holocaust? And why was the meeting necessary? Hundreds of thousands of Jews had already been shot by squads in Russia or gassed in the camp at Chelmno. Mark Roseman seeks to unravel this double mystery and explain how it was that on a snowy day, fifteen well-educated young men met to talk murder.
