Описание: The purpose of this report is to comprehensively examine the U.S. Government's compliance with federal immigration laws and detention policies, and also detail evidence regarding possible infringement upon the constitutional rights afforded to detained immigrants. More specifically, this report examines the Department of Homeland Security (DHS) and its component agencies' treatment of detained immigrants in immigration holding, processing, and detention centers throughout the United States.Prior to writing this report, the Commission gathered facts and data to analyze whether DHS, its component agencies, and private detention corporations with whom the federal government contracts to detain immigrants were complying with the Performance Based National Detention Standards, Prison Rape Elimination Act Standards, the Flores Settlement Agreement and other related immigrant child detention policies, and the United States Constitution. During the Commission's January 30, 2015 briefing, the Commission received written and oral testimony from DHS immigration detention officials and advocates detailing the strengths, weaknesses, and constitutional and civil rights implications of the U.S. immigration detention system. In May 2015, the Commission visited Karnes Family Detention Center and Port Isabel Detention Centers - both located in Texas - to corroborate the written and oral evidence the Commission gathered. The Commission believes that this report is both instructive and useful to the U.S. Government and the public at large as a contribution to the public dialogue surrounding civil rights and constitutional issues in the U.S. immigration detention system. The Commission is confident that this report will aid in the ultimate resolution of those issues, and that one day the United States may truly live up to its reputation of being the land of the free.

Before the turn of the century, few states used immigration detention. Today, nearly every state around the world has adopted immigration detention policy in some form. States practice detention as a means to address both the accelerating numbers of people crossing their borders, and the populations residing in their states without authorisation.
This edited volume examines the contemporary diffusion of immigration detention policy throughout the world and the impact of this expansion on the prospects of protection for people seeking asylum. It includes contributions by immigration detention experts working in Australasia, the Americas, Europe, Africa and the Middle East. It is the first to set out a systematic comparison of immigration detention policy across these regions and to examine how immigration detention has become a ubiquitous part of border and immigration control strategies globally. In so doing, the volume presents a global perspective on the diversity of immigration detention policies and practices, how these circumstances developed, and the human impact of states exchanging individuals' rights to liberty for the collective assurance of border and immigration control.
This text will be of key interest to scholars, students and practitioners of immigration, migration, public administration, comparative policy studies, comparative politics and international political economy.

Описание: The impact of the U.S. immigration and legal systems on children and youth In the United States, millions of children are undocumented migrants or have family members who came to the country without authorization. The unique challenges with which these children and youth must cope demand special attention. Illegal Encounters considers illegality, deportability, and deportation in the lives of young people—those who migrate as well as those who are affected by the migration of others. A primary focus of the volume is to understand how children and youth encounter, move through, or are outside of a range of legal processes, including border enforcement, immigration detention, federal custody, courts, and state processes of categorization. Even if young people do not directly interact with state immigration systems—because they are U.S. citizens or have avoided detention—they are nonetheless deeply affected by the reach of the government in its many forms. Contributors privilege the voices and everyday experiences of immigrant children and youth themselves. By combining different perspectives from advocates, service providers, attorneys, researchers, and young immigrants, the volume presents rich accounts that can contribute to informed debates and policy reforms. Illegal Encounters sheds light on the unique ways in which policies, laws, and legal categories shape so much of daily life for young immigrants. The book makes visible the burdens, hopes, and potential of a population of young people and their families who have been largely hidden from public view and are currently under siege, following their movement through complicated immigration systems and institutions in the United States.

Описание: This book takes a critical, interdisciplinary, and transnational look at immigration enforcement. It connects neoliberal governance, global labor markets, and the national obsession with securing borders to recast deportation, detention, and border-control policies in the United States and worldwide in terms of a decades-long "age of punishment."
Its brilliant prose makes [Empire's Mobius Strip] easily accessible to anyone interested in today's migration crisis in the Mediterranean and elsewhere in the world. ? American Historical Review
Italy's current crisis of Mediterranean migration and detention has its roots in early twentieth century imperial ambitions. Empire's Mobius Strip investigates how mobile populations were perceived to be major threats to Italian colonization, and how the state's historical mechanisms of control have resurfaced, with greater force, in today's refugee crisis.
What is at stake in Empire's Mobius Strip is a deeper understanding of the forces driving those who move by choice and those who are moved. Stephanie Malia Hom focuses on Libya, considered Italy's most valuable colony, both politically and economically. Often perceived as the least of the great powers, Italian imperialism has been framed as something of "colonialism lite." But Italian colonizers carried out genocide between 1929–33, targeting nomadic Bedouin and marching almost 100,000 of them across the desert, incarcerating them in camps where more than half who entered died, simply because the Italians considered their way of life suspect. There are uncanny echoes with the situation of the Roma and migrants today. Hom explores three sites, in novella-like essays, where Italy's colonial past touches down in the present: the island, the camp, and the village.
Empire's Mobius Strip brings into relief Italy's shifting constellations of mobility and empire, giving them space to surface, submerge, stretch out across time, and fold back on themselves like a Mobius strip. It deftly shows that mobility forges lasting connections between colonial imperialism and neoliberal empire, establishing Italy as a key site for the study of imperial formations in Europe and the Mediterranean.

Immigration is among the most prominent, enduring, and contentious features of our globalized world. Yet, there is little systematic, cross-national research on why countries "do what they do" when it comes to their immigration policies. Rights, Deportation, and Detention in the Age of Immigration Control addresses this gap by examining what are arguably the most contested and dynamic immigration policies-immigration control-across 25 immigrant-receiving countries, including the U.S. and most of the European Union. The book addresses head on three of the most salient aspects of immigration control: the denial of rights to non-citizens, their physical removal and exclusion from the polity through deportation, and their deprivation of liberty and freedom of movement in immigration detention.
In addition to answering the question of why states do what they do, the book describes contemporary trends in what Tom K. Wong refers to as the machinery of immigration control, analyzes the determinants of these trends using a combination of quantitative analysis and fieldwork, and explores whether efforts to deter unwanted immigration are actually working.

Immigration detention is considered by many states to be a necessary tool in the execution of immigration policy. Despite the apparently key role it plays in immigration enforcement, the law on immigration detention is often vague, especially in relation to determining the circumstances under which prolonged detention remains lawful. As a result, the courts are frequently called upon to adjudicate these matters, with scant legal tools at their disposal. Though there have been some significant judgments on the legality of detention at the constitutional level, the extent to which these judgments have had an impact at the lower end of the judiciary is unclear. Indeed, it is the lower courts which are tasked with judging the legality of detention through habeas corpus or judicial review proceedings.
This book examines the way this has occurred in the lower courts of two jurisdictions, the UK and the US, and contrasts this practice not only in those jurisdictions, but with judgments rendered by the Court of Justice of the European Union, a constitutional court at the other end of the judicial spectrum whose judgments are applied by courts and tribunals in the EU Member States. Although these three jurisdictions use similar tests to evaluate the legality of detention, case outcomes significantly differ. Many factors contribute to this divergence, but key among them is the role that fundamental rights protection plays in each jurisdiction. Through a forensic evaluation of 191 judgments, this book compares the laws on detention in the UK, US and EU, and makes recommendations to these jurisdictions for improvement.
