Описание: In the late nineteenth century, progressive reformers recoiled at the prospect of the justice system punishing children as adults. Advocating that children's inherent innocence warranted fundamentally different treatment, reformers founded the nation's first juvenile court in Chicago in 1899. Yet amidst an influx of new African American arrivals to the city during the Great Migration, notions of inherent childhood innocence and juvenile justice were circumscribed by race. In documenting how blackness became a marker of criminality that overrode the potential protections the status of ""child"" could have bestowed, Tera Eva Agyepong shows the entanglements between race and the state's transition to a more punitive form of juvenile justice.

This important study expands the narrative of racialized criminalization in America, revealing that these patterns became embedded in a justice system originally intended to protect children. In doing so, Agyepong also complicates our understanding of the nature of migration and what it meant to be black and living in Chicago in the early twentieth century.

stark disparity exists between black and white youth experiences in the justice
system today. Black youths are perceived to be older and less innocent than
their white peers. When it comes to incarceration, race trumps class, and even
as black youths articulate their own experiences with carceral authorities,
many Americans remain surprised by the inequalities they continue to endure. In
this revealing book, Carl Suddler brings to light a much longer history of the
policies and strategies that tethered the lives of black youths to the justice
system indefinitely.

The
criminalization of black youth is inseparable from its racialized origins. In
the mid-twentieth century, the United States justice system began to focus on
punishment, rather than rehabilitation. By the time the federal government began
to address the issue of juvenile delinquency, the juvenile justice system shifted its priorities from saving delinquent youth to purely
controlling crime, and black teens bore the brunt of the transition.

In
New York City, increased state surveillance of predominantly black communities
compounded arrest rates during the post-World War II period, providing
justification for tough-on-crime policies. Questionable police practices, like
stop-and-frisk, combined with media sensationalism, cemented the belief that
black youth were the primary cause for concern. Even before the War on Crime,
the stakes were clear: race would continue to be the crucial determinant in
American notions of crime and delinquency, and black youths condemned with a
stigma of criminality would continue
to confront the overwhelming power of the state.

The number of people incarcerated in the U.S. now exceeds 2.3 million, due in part to the increasing criminalization of drug use: over 25% of people incarcerated in jails and prisons are there for drug offenses. Judging Addicts examines this increased criminalization of drugs and the medicalization of addiction in the U.S. by focusing on drug courts, where defendants are sent to drug treatment instead of prison. Rebecca Tiger explores how advocates of these courts make their case for what they call “enlightened coercion,” detailing how they use medical theories of addiction to justify increased criminal justice oversight of defendants who, through this process, are defined as both “sick” and “bad.”
Tiger shows how these courts fuse punitive and therapeutic approaches to drug use in the name of a “progressive” and “enlightened” approach to addiction. She critiques the medicalization of drug users, showing how the disease designation can complement, rather than contradict, punitive approaches, demonstrating that these courts are neither unprecedented nor unique, and that they contain great potential to expand punitive control over drug users. Tiger argues that the medicalization of addiction has done little to stem the punishment of drug users because of a key conceptual overlap in the medical and punitive approaches—that habitual drug use is a problem that needs to be fixed through sobriety.
