Dr. Milena Gordon Baker analyzes Holocaust denial in Brazil from the perspective posed by intolerance and hate speech, specifically in the context of penal law. Using these concepts and contexts, she investigates which legal approach should be used to confront Holocaust denial and appropriately respond to the core issues raised. Leveraging the perspective of international penal law supported by local legislation, she asks whether Holocaust denial should be criminalized in Brazil, making existing constitutional guarantees effective in order to repudiate racism and actively combat hate speech.
"The publication of Milena Gordon Baker's thesis could hardly have come at a better time. By coincidence, at the precise moment when I was reviewing her text, the construction of the Holocaust Monument in the city of Rio de Janeiro had just started. Like other cities in Brazil that boast major Holocaust memorials and museums, my city too is finally fulfilling its promise to raise a worthy monument to the victims. Steps to preserve and pay tribute to the memory of the victims of the unspeakable genocide go hand in hand in many countries--as Dr. Baker demonstrates--with making it a crime to deny the Holocaust. The book you are about to read provides important food for thought on this subject..." --Ellen Gracie Northfleet, Former Brazilian Supreme Court Justice
When the regime led by Slobodan Miloševi? came to an end in October 2000, expectations for social transformation in Serbia and the rest of the Balkans were high. The international community declared that an era of human rights had begun, while domestic actors hoped that the conditions that had made a violent dictatorship possible could be eliminated. More than a decade after the International Criminal Tribunal for the Former Yugoslavia initiated the process of bringing violators of international humanitarian law to justice, significant legal precedents and facts have been established, yet considerable gaps in the historical record, along with denial and disagreements, continue to exist in the public memory of the Yugoslav wars. Guilt, Responsibility, and Denial sets out to trace the political, social, and moral challenges that Serbia faced from 2000 onward, offering an empirically rich and theoretically broad account of what was demanded of the country's citizens as well its political leadership—and how these challenges were alternately confronted and ignored. Eric Gordy makes extensive use of Serbian media to capture the internal debate surrounding the legacy of the country's war crimes, providing one of the first studies to examine international institutional efforts to build a set of public memories alongside domestic Serbian political reaction. By combining news accounts, courtroom transcripts, online discussions, and his own field research, Gordy explores how the conflicts and crimes that were committed under Miloševi? came to be understood by the people of Serbia and, more broadly, how projects of transitional justice affect the ways society faces issues of guilt and responsibility. In charting the legal, political, and cultural forces that shape public memory, Guilt, Responsibility, and Denial promises to become a standard resource for studies of Serbia as well as the workings of international and domestic justice in dealing with the aftermath of war crimes.

Описание: While much of the international community regards the forced deportation of Armenian subjects of the Ottoman Empire in 1915, where approximately 800,000 to 1.5 million Armenians perished, as genocide, the Turkish state still officially denies it. In Denial of Violence, Fatma Mge Gek seeks to decipher the roots of this disavowal. To capture the negotiation of meaning that leads to denial, Gek undertook a qualitative analysis of 315 memoirs published in Turkey from 1789 to 2009 in addition to numerous secondary sources, journals, and newspapers. She argues that denial is a multi-layered, historical process with four distinct yet overlapping components: the structural elements of collective violence and situated modernity on one side, and the emotional elements of collective emotions and legitimating events on the other. In the Turkish case, denial emerged through four stages: (i) the initial imperial denial of the origins of the collective violence committed against the Armenians commenced in 1789 and continued until 1907; (ii) the Young Turk denial of the act of violence lasted for a decade from 1908 to 1918; (iii) early republican denial of the actors of violence took place from 1919 to 1973; and (iv) the late republican denial of the responsibility for the collective violence started in 1974 and continues today. Denial of Violence develops a novel theoretical, historical and methodological framework to understanding what happened and why the denial of collective violence against Armenians still persists within Turkish state and society.

Описание: The purely scholarly problem of determining the number of victims, like other aspects of demography related to the Holocaust, have suddenly become closely embroiled in geopolitics and the phenomenon of Holocaust denial, which is now a context that has been forced upon it. This is imbued with these connections and interrelationships.
Автор: Davina Cooper Название: Feeling Like a State: Desire, Denial, and the Recasting of Authority ISBN: 1478004746 ISBN-13(EAN): 9781478004745 Издательство: Mare Nostrum (Eurospan) Рейтинг: Цена: 29220.00 T Наличие на складе: Есть у поставщика Поставка под заказ. Описание: A transformative progressive politics requires the state's reimagining. But how should the state be reimagined, and what can invigorate this process? In Feeling Like a State, Davina Cooper explores the unexpected contribution a legal drama of withdrawal might make to conceptualizing a more socially just, participative state. In recent years, as gay rights have expanded, some conservative Christians—from charities to guesthouse owners and county clerks—have denied people inclusion, goods, and services because of their sexuality. In turn, liberal public bodies have withdrawn contracts, subsidies, and career progression from withholding conservative Christians. Cooper takes up the discourses and practices expressed in this legal conflict to animate and support an account of the state as heterogeneous, plural, and erotic. Arguing for the urgent need to put new imaginative forms into practice, Cooper examines how dissident and experimental institutional thinking materialize as people assert a democratic readiness to recraft the state.
In a wide-ranging interpretation of French thought in the years 1670-1789, Daniel Gordon takes us through the literature of manners and moral philosophy, theology and political theory, universal history and economics to show how French thinkers sustained a sense of liberty and dignity within an authoritarian regime. A penetrating critique of those who exaggerate either the radicalism of the Enlightenment or the hegemony of the absolutist state, his book documents the invention of an ethos that was neither democratic nor absolutist, an ethos that idealized communication and private life. The key to this ethos was "sociability," and Gordon offers the first detailed study of the language and ideas that gave this concept its meaning in the Old Regime. Citizens without Sovereignty provides a wealth of information about the origins and usage of key words, such as sociйtй and sociabilitй, in French thought. From semantic fields of meaning, Gordon goes on to consider institutional fields of action. Focusing on the ubiquitous idea of "society" as a depoliticized sphere of equality, virtue, and aesthetic cultivation, he marks out the philosophical space that lies between the idea of democracy and the idea of the royal police state. Within this space, Gordon reveals the channels of creative action that are open to citizens without sovereignty--citizens who have no right to self-government. His work is thus a contribution to general historical sociology as well as French intellectual history.

Описание: This volume aims to question, challenge, supplement, and revise current understandings of the relationship between aesthetic and political operations. The authors transcend disciplinary boundaries and nurture a wide-ranging sensibility about art and sovereignty, two highly complex and interwoven dimensions of human experience that have rarely been explored by scholars in one conceptual space. Several chapters consider the intertwining of modern philosophical currents and modernist artistic forms, in particular those revealing formal abstraction, stylistic experimentation, self-conscious expression, and resistance to traditional definitions of “Art.” Other chapters deal with currents that emerged as facets of art became increasingly commercialized, merging with industrial design and popular entertainment industries. Some contributors address Post-Modernist art and theory, highlighting power relations and providing sceptical, critical commentary on repercussions of colonialism and notions of universal truths rooted in Western ideals. By interfering with established dichotomies and unsettling stable debates related to art and sovereignty, all contributors frame new perspectives on the co-constitution of artworks and practices of sovereignty.
