Описание: The European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment was adopted by the Committee of Ministers of the Council of Europe in June 1987. It entered into force in February 1989 and all 47 member States are Parties to the Convention. The Convention has already established itself as an important human rights instrument. Its approach is quite different from that of the European Convention on Human Rights. Whereas the ECHR provides a remedy for particular human rights violations after the event, the Convention for the Prevention of Torture (ECPT) seeks to prevent human rights violations, through a system of visits to places of detention. The Convention is intended to be an integrated part of the Council of Europe system for the protection of human rights, placing a proactive non-judicial mechanism alongside the reactive judicial mechanism established under the ECHR. The Yearbook of the European Convention for the Prevention of Torture offers an essential annual overview of developments in relation to the ECPT. The present volume is arranged as follows: Part One contains information as to ratifications, etc, as at 31 December 2013 in the authentic English and French texts. Part Two has details in English and French of the membership and activities of the CPT for 2013. Part Three reprints the twenty-third annual General Report of the CPT in the official English and French texts. Part Four contains the CPT's reports to States and the State responses thereto that were made public during 2013. The CPT's reports are published in the official English and/or French texts and State responses in the English and/ or French versions submitted by the States concerned.
Bilingual English and French; 3-volume set.

Описание: Residential care and treatment for children and youth remain ubiquitous across Canada in spite of frequent critiques and an ideology of constructing group care as a last resort. In the first book of its kind, Dr. Kiaras Gharabaghi argues that the absence of a unifying theory or conceptual idea(s) pursuant to residential care and treatment perpetuate dynamics of mediocrity and complacency toward inadequate standards and practices. Drawing on organizational examples from across Canada, Gharabaghi re-constructs the possibilities for this form of care as a space for healing, growth, and the promotion of autonomy for young people. This well-timed resource offers the child and youth services community a positive, constructive, and revolutionary framework for residential care and treatment that is fundamentally based on a partnership between caregivers and young people, their families, neighbourhoods, and communities. Dr. Gharabaghi’s sophisticated and provocative analysis of the system’s key issues is essential reading for students, practitioners, and educators in the field of child and youth care and in the human services more broadly.Features:explores residential care and treatment with a focus on the needs of unique populations, such as black youth, Indigenous youth, and young people impacted by developmental disability or neurodevelopmental challengesemphasizes the voices and participation of young people with lived experience in residential care and treatmentwritten in a uniquely Canadian context, but its theoretical elements draw on residential care in the United States, Germany, South Africa, and elsewhere

Описание: Critics have decried human rights approaches` a failure to attend to structural factors, but this book seeks to go beyond a `stance of criticism`. It takes up the positive project of reimagining how human rights could attend to the worlds that produce systematic violations like torture so as to prevent it.
We are accustomed to thinking of torture as the purposeful infliction of cruelty by public officials, and we assume that lawyers and clinicians are best placed to speak about its causes and effects. However, it has not always been so. The category of torture is a very specific way of thinking about violence, and our current understandings of the term are rooted in recent twentieth-century history. In This Side of Silence, social anthropologist Tobias Kelly argues that the tensions between post-Cold War armed conflict, human rights activism, medical notions of suffering, and concerns over immigration have produced a distinctively new way of thinking about torture, which is saturated with notions of law and trauma. This Side of Silence asks what forms of suffering and cruelty can be acknowledged when looking at the world through the narrow legal category of torture. The book focuses on the recent history of Britain but draws wider comparative conclusions, tracing attempts to recognize survivors and perpetrators across the fields of asylum, criminal law, international human rights, and military justice. In this thorough and eloquent ethnography, Kelly avoids treating the legal prohibition of torture as the inevitable product of progress and yet does not seek to dismiss the real differences it has made in concrete political struggles. Based on extensive archival research and ethnographic fieldwork, the book argues that the problem of recognition rests not in the inability of the survivor to communicate but in our inability to listen and take responsibility for the injustice before us.

Over the past fifty years, debates about human rights have assumed an increasingly prominent place in postcolonial literature and theory. Writers from Salman Rushdie to Nawal El Saadawi have used the novel to explore both the possibilities and challenges of enacting and protecting human rights, particularly in the Global South. In Fictions of Dignity, Elizabeth S. Anker shows how the dual enabling fictions of human dignity and bodily integrity contribute to an anxiety about the body that helps to explain many of the contemporary and historical failures of human rights, revealing why and how lives are excluded from human rights protections along the lines of race, gender, class, disability, and species membership. In the process, Anker examines the vital work performed by a particular kind of narrative imagination in fostering respect for human rights. Drawing on phenomenology, Anker suggests how an embodied politics of reading might restore a vital fleshiness to the overly abstract, decorporealized subject of liberal rights.
Each of the novels Anker examines approaches human rights in terms of limits and paradoxes. Rushdie's Midnight's Children addresses the obstacles to incorporating rights into a formerly colonized nation's legal culture. El Saadawi’s Woman at Point Zero takes up controversies over women’s freedoms in Islamic society. In Disgrace, J. M. Coetzee considers the disappointments of post-apartheid reconciliation in South Africa. And in The God of Small Things, Arundhati Roy confronts an array of human rights abuses widespread in contemporary India. Each of these literary case studies further demonstrates the relevance of embodiment to both comprehending and redressing the failures of human rights, even while those narratives refuse simplistic ideals or solutions.
