Описание: This book draws together established and emerging scholars from sociology, law, history, political science and education to examine the global and local issues in the pursuit of gender justice in post-conflict settings. This examination is especially important given the disappointing progress made to date in spite of concerted efforts over the last two decades. With contributions from both academics and practitioners working at national and international levels, this work integrates theory and practice, examining both global problems and highly contextual case studies including Kenya, Somalia, Peru, Afghanistan and DRC. The contributors aim to provide a comprehensive and compelling argument for the need to fundamentally rethink global approaches to gender justice.
This book explores the objectives pursued in donor programs, the methods used to advance them, and the underlying assumptions and strategies. It emphasizes the unexpected and sometimes unpleasant consequences of ignoring not only political and societal constraints but also advances in our technical approaches to performance improvement, the one area where the First World has a comparative advantage. The geographic scope of the work is broad, incorporating examples from Eastern and Central Europe, Latin America, Africa, and the Asia-Pacific region as well as from several First World nations.
Justice Reform and Development examines First World assistance to justice or "rule of law" reforms in developing and transitional societies, arguing that its purported failure is vastly exaggerated, largely because of unrealistic expectations as to what could be accomplished. Change nonetheless is needed if the programs are to continue and would be best based on targeting specific performance problems, incorporation of donor countries' experience with their own reforms, and greater attention to relevant research.
While contributing to an on-going debate among practitioners and academics involved in justice programs, this book will also be accessible to readers with little exposure to the topics, especially advanced undergraduate and graduate students in law, political science and areas studies.

Описание: This volume counters one-sided dominant discursive representations of gender in human rights and transitional justice, and women’s place in the transformations of neoliberal human rights, and contributes a more balanced examination of how transitional justice and human rights institutions, and political institutions impact the lives and experiences of women. Using a multidisciplinary approach, the contributors to this volume theorize and historicize the place of women’s rights (and gender), situating it within contemporary country-specific political, legal, socio-cultural and global contexts. Chapters examine the progress and challenges facing women (and women’s groups) in transitioning countries: from Peru to Argentina, from Kenya to Sierra Leone, and from Bosnia to Sri Lanka, in a variety of contexts, attending especially to the relationships between local and global forces

Описание: This book examines and offers suggestions for how post-conflict practices should conceptualize and address harms committed by child soldiers for successful social reconstruction in the aftermath of mass atrocity. It defends the use of accountability and considers the agency of youth participants in violent conflict as responsible moral entities.
This short and accessible book is the first to focus exclusively on the inter-relation between transitional justice and rule of law reconstruction in post-conflict and post-authoritarian states. In so doing it provides a provocative reassessment of the various tangled relationships between the two fields, exploring the blind-spots, contradictions and opportunities for mutually-beneficial synergies in practice and scholarship between them. Though it is commonly assumed that transitional justice for past human rights abuses is inherently conducive to restoring the rule of law, differences in how both fields conceptualise the rule of law, the scope of transition and obligations to citizens have resulted in divergent approaches to transitional criminal trial, international criminal law, restorative justice and traditional justice mechanisms. Adopting a critical comparative approach that assesses the experiences of post-authoritarian and post-conflict polities in Latin America, Asia, Europe and Africa undergoing transitional justice and justice sector reform simultaneously, it argues that the potential benefits of transitional justice are exaggerated and urges policy-makers to rebalance the compromises inherent in transitional justice mechanisms against the foundational demands of rule of law reconstruction. This book will be of interest to scholars in the fields of transitional justice, rule of law, legal pluralism and peace-building concerned by the failure of transitional justice to leave a positive legacy to the justice system of the states where it operates.
'This is a bold and nuanced scrutiny of the international system's approach to transitional justice and the much vaunted rule of law project. Dr McAulifee should be congratulated for this well-researched book which should be a must read for not only scholars and researchers in transitional justice and peace and conflict studies, but also policy-makers in the international system.' Dr. Hakeem O. Yusuf, Senior Lecturer, University of Strathclyde and author of Transitional Justice, Judicial Accountability and the Rule of Law.
In the context of sustainable development, recent land debates tend to construct two porous camps. On the one side, norms of land justice and their advocates dictate that people's rights to tenure security are tantamount and even sometimes key to successful conservation practice. On the other hand, biodiversity protection and conservation advocates, supported by global environmental organizations and states, remain committed to conservation strategies, steeped in genetics and biological sciences, working on behalf of a "global" mandate for biodiversity and climate change mitigation.
Land Rights, Biodiversity Conservation and Justice seeks to illuminate struggles for land and territory in the context of biodiversity conservation. This edited volume explores the particular ideologies, narratives and practices that are mobilized when the agendas of biodiversity conservation practice meet, clash, and blend with the demands for land and access and control of resources from people living in, and in close proximity to, parks.
The book maintains that, while biodiversity conservation is an important goal in a time where climate change is a real threat to human existence, the successful and just future of biodiversity conservation is contingent upon land tenure security for local people. The original research gathered together in this volume will be of considerable interest to researchers of development studies, political ecology, land rights, and conservation.

Описание: “A very valuable and much needed book on a central element in the processes of social change: the construction and reconstruction of social norms as they move between global and local levels.” —Naila Kabeer, London School of Economics and Political Science, UK “This book explores how gender equality norms are ever-evolving and argues convincingly that we cannot take their effectiveness, nor their acceptance, for granted.” —Judith Kelley, Duke Sanford School of Public Policy, USA“In an era of increasing resistance to gender equality, this is a much-needed volume that attends to how gender equality norms are interpreted and contested in governance organisations ranging from the UN and the EU to Mercosur and women’s NGOs in India and Uganda.” —Ann Towns, University of Gothenburg, SwedenThis edited collection provides a new theoretical approach to the study of how global norms influence social processes. It analyses the institutional and highly political processes whereby actors – be they local, national, regional or trans-national – engage with global norms of gender equality. The editors bring together key thinkers who emphasise how context and history effect norm engagement and how particular groups and actors tend to be marginalised from discussions of global norms. By proposing a situated approach that underlines the contingent, multi-level processes that occur when actors interpret, use, manipulate, bend, or betray norms, notions of norm diffusion are fundamentally challenged. This book makes a further crucial contribution to the study of norms and gender equality in global governance by analysing very different empirical contexts, from New Delhi and St. Petersburg to the Organisation of American States, and from Kampala and New York to the European Union.
