Описание: In this book Aoife Daly argues that where courts decide children’s best interests (for example about parental contact) the UN Convention on the Rights of the Childs right to be heard is insufficient, and autonomy should instead be the focus. Global law and practice indicate that children are regularly denied due process rights in their own best interest proceedings and find their wishes easily overridden. It is argued that a children’s autonomy principle, respecting children’s wishes unless significant harm would likely result, would ensure greater support for children in proceedings, and greater obligations on adults to engage in transparent decision-making. This book is a call for a reconceptualisation of the status of children in a key area of children’s rights.

Описание: Despite the significant growth of academic interest in both children's rights and socio-economic rights over the last two decades, children's socio-economic rights are a comparatively neglected area. This is particularly true with regard to the role of the courts in the enforcement of such rights. Author Aoife Nolan's book - now available in paperback - remedies this omission, focusing on the circumstances in which the courts can and should give effect to the socio-economic rights of children. The arguments put forward are located within the context of long-standing debates in constitutional law, democratic theory, and human rights. The claims made by the author are supported and illustrated by concrete examples of judicial enforcement of children's socio-economic rights from a variety of jurisdictions. The work is thus rooted in both theory and practice, and represents a major original contribution to the existing scholarship in a range of areas, including human rights, legal and political theory, and constitutional law. The book brings together and addresses a wide range of issues, including: children as citizens and their position in relation to democratic decision-making processes * the implications of children and their rights for democratic and constitutional theory * the role of the courts in ensuring the enforcement of children's rights * the debates surrounding the litigation and adjudication of socio-economic rights. *** Children's Socio-Economic Rights, Democracy and the Courts was the winner of the Kevin Boyle Book Prize 2012 for Outstanding Legal Scholarship. Описание: During the first two decades following the Mexican Revolution, children in the country gained unprecedented consideration as viable cultural critics, social actors, and subjects of reform. Not only did they become central to the reform agenda of the revolutionary nationalist government; they were also the beneficiaries of the largest percentage of the national budget. While most historical accounts of postrevolutionary Mexico omit discussion of how children themselves experienced and perceived the sudden onslaught of resources and attention, Elena Jackson Albarr n, in Seen and Heard in Mexico, places children's voices at the center of her analysis. Albarr n draws on archived records of children's experiences in the form of letters, stories, scripts, drawings, interviews, presentations, and homework assignments to explore how Mexican childhood, despite the hopeful visions of revolutionary ideologues, was not a uniform experience set against the monolithic backdrop of cultural nationalism, but rather was varied and uneven. Moving children from the aesthetic to the political realm, Albarr n situates them in their rightful place at the center of Mexico's revolutionary narrative by examining the avenues through which children contributed to ideas about citizenship and nation. Elena Jackson Albarr n is an assistant professor in the history department and the Latin American, Latino/a, and Caribbean Studies Program at Miami University.

Описание: Actio Popularis before International Courts and Tribunals examines actio popularis in the context of the symbiotic relationship between procedural and substantive normativity in international law. Actio popularis is an important procedural tool devised to address the challenges posed by the relativization of substantive normativity and recognition of norms established to protect collective interests in international law. Farid Ahmadov’s analysis underlines the ineffectiveness of bipolar litigation in enforcement of collective obligations in international law and the importance of introducing new procedural mechanisms to address the challenges posed by the transition from bilateralist to multilateralist normativity. The volume highlights the subtle link between interpretation of standing rules and the ways in which judicial policy concerns inform decisions of international courts and tribunals on admissibility of actio popularis.
