Описание: In this timely work, Eric Freyfogle probes the long-simmering struggles in the American West to address water-related problem. The big challenge is to resolve water shortages and meet high-valued water needs while also improving river ecosystems. These water conflicts, he suggests, have less to do with our contentious political differences than they do with longstanding core elements of American culture—inherited, shared ways of understanding our place in nature that no longer make good sense. Particularly troublesome are the ways we fragment it, valuing its parts as discrete commodities. Also at play is our cultural inability to think clearly about how best to draw the line between the legitimate use of nature and the abuse of it.    Building on these cultural critiques, Freyfogle takes up the issue of private property rights, highlighting the longstanding flexibility of this key American institution as well as the moral imperative to ensure that property rights aren’t used in ways that harm communities. Outdated understandings about private property, he concludes, have further confused our understanding and made sensible solutions to water problems even harder to imagine. Water-policy reform won’t happen, Freyfogle argues, until we reconsider how we understand nature and take charge of the institution of ownership, recasting it so as to increase the benefits it generates for everyone. If we can do that, solutions to water troubles could prove easier than we expect. The work concludes with an original, sweeping policy proposal to resolve the West’s water shortages and meet environmental needs in ways fair to all.   This lecture was presented on March 22, 2017, at the 22nd annual symposium sponsored by the Wallace Stegner Center for Land, Resources and the Environment at the S. J. Quinney College of Law, University of Utah.

Seemingly in the middle of nowhere, Devil's Gate is the center of a landscape that threatens to shrink any inhabitants to insignificance except for one thing: ownership of the land and the stories they choose to tell about it. The static serenity of the once heavily traveled region masks a history of conflict. Tom Sun, an early rancher, played a role here in the lynching of the only woman ever hanged in Wyoming. The lynching was dismissed as swift frontier justice in the wake of cattle theft, but Rea finds more complicated motives that involve land and water rights. The Sun name was linked with the land for generations. In the 1990s, the Mormon Church purchased part of the Sun ranch to memorialize Martin's Cove as the site of handcart pioneers who froze to death in the valley in 1856. The treeless, arid country around Devil's Gate seems too immense for ownership. But stories run with the land. People who own the land can own the stories, at least for a time. Описание: The federally recognized Round Valley Indian Tribes are a small, confederated people whose members today come from twelve indigenous California tribes. In 1849, during the California gold rush, people from several of these tribes were relocated to a reservation farm in northern Mendocino County. Fusing Native American history and labor history, William Bauer Jr. chronicles the evolution of work, community, and tribal identity among the Round Valley Indians in the nineteenth and twentieth centuries that enabled their survival and resistance to assimilation. <BR><BR>Drawing on oral history interviews, Bauer brings Round Valley Indian voices to the forefront in a narrative that traces their adaptations to shifting social and economic realities, first within unfree labor systems, including outright slavery and debt peonage, and later as wage laborers within the agricultural workforce. Описание: In countless ways, the Yuchi (Euchee) people are unique among their fellow Oklahomans and Native peoples of North America. Inheritors of a language unrelated to any other, the Yuchi preserve a strong cultural identity. In part because they have not yet won federal recognition as a tribe, the Yuchi are largely unknown among their non-Native neighbors and often misunderstood in scholarship. Jason Baird Jackson's Yuchi Folklore, the result of twenty years of collaboration with Yuchi people and one of just a handful of works considering their experience, brings Yuchi cultural expression to light.
Yuchi Folklore examines expressive genres and customs that have long been of special interest to Yuchi people themselves. Beginning with an overview of Yuchi history and ethnography, the book explores four categories of cultural expression: verbal or spoken art, material culture, cultural performance, and worldview. In describing oratory, food, architecture, and dance, Jackson visits and revisits the themes of cultural persistence and social interaction, initially between Yuchi and other peoples east of the Mississippi and now in northeastern Oklahoma. The Yuchi exist in a complex, shifting relationship with the federally recognized Muscogee (Creek) Nation, with which they were removed to Indian Territory in the 1830s.
Jackson shows how Yuchi cultural forms, values, customs, and practices constantly combine as Yuchi people adapt to new circumstances and everyday life. To be Yuchi today is, for example, to successfully negotiate a world where commercial rap and country music coexist with Native-language hymns and doctoring songs. While centered on Yuchi community life, this volume of essays also illustrates the discipline of folklore studies and offers perspectives for advancing a broader understanding of Woodlands peoples across the breadth of the American South and East.
