But if the assured intending to take his own life, kills him self, is it a good replication to a plea that he died by his own hand, that the act was committed while he was of unsound mind? The answer to this question involves a consideration of the liability, civilly, of a lunatic for his acts and contracts.

It is a good plea to a criminal prosecution that the offence was committed by a lunatic. But a lunatic is civilly liable for torts committed by him, and in many cases also upon his contracts. In Weaver v. Ward, Hobart 189, it is said If a lunatic kill a man, or the like, this shall be no felony.
