The Rights and Wrongs of Land Restitution: 'Restoring What Was Ours'
offers a critical, comparative ethnographic, examination of land restitution programs. Drawing on memories and histories of past dispossession, governments, NGOs, informal movements and individual claimants worldwide have attempted to restore and reclaim rights in land. Land restitution programs link the past and the present, and may allow former landholders to reclaim lands which provided the basis of earlier identities and livelihoods. Restitution also has a moral weight that holds broad appeal; it is represented as righting injustice and healing the injuries of colonialism. Restitution may have unofficial purposes, like establishing the legitimacy of a new regime, quelling popular discontent, or attracting donor funds. It may produce unintended consequences, transforming notions of property and ownership, entrenching local bureaucracies, or replicating segregated patterns of land use. It may also constitute new relations between states and their subjects. Land-claiming communities may make new claims on the state, but they may also find the state making unexpected claims on their land and livelihoods. Restitution may be a route to citizenship, but it may engender new or neo-traditional forms of subjection. This volume explores these possibilities and pitfalls by examining cases from the Americas, Eastern Europe, Australia and South Africa. Addressing the practical and theoretical questions that arise, The Rights and Wrongs of Land Restitution thereby offers a critical rethinking of the links between land restitution and property, social transition, injustice, citizenship, the state and the market.
In the context of sustainable development, recent land debates tend to construct two porous camps. On the one side, norms of land justice and their advocates dictate that people's rights to tenure security are tantamount and even sometimes key to successful conservation practice. On the other hand, biodiversity protection and conservation advocates, supported by global environmental organizations and states, remain committed to conservation strategies, steeped in genetics and biological sciences, working on behalf of a "global" mandate for biodiversity and climate change mitigation.
Land Rights, Biodiversity Conservation and Justice seeks to illuminate struggles for land and territory in the context of biodiversity conservation. This edited volume explores the particular ideologies, narratives and practices that are mobilized when the agendas of biodiversity conservation practice meet, clash, and blend with the demands for land and access and control of resources from people living in, and in close proximity to, parks.
The book maintains that, while biodiversity conservation is an important goal in a time where climate change is a real threat to human existence, the successful and just future of biodiversity conservation is contingent upon land tenure security for local people. Domestic and international development strategies often focus on private ownership as a crucial anchor for long-term investment; the security of property rights provides a foundation for capitalist expansion. In recent years, Thailand's policies have been hailed as a prime example of how granting formal land rights to poor farmers in low-income countries can result in economic benefits. But the country provides a puzzle: Thailand faced major security threats from colonial powers in the nineteenth century and from communism in the twentieth century, yet only in the latter case did the government respond with pro-development tactics.
In Land and Loyalty, Tomas Larsson argues that institutional underdevelopment may prove, under certain circumstances, a strategic advantage rather than a weakness and that external threats play an important role in shaping the development of property regimes. Security concerns, he find, often guide economic policy. The domestic legacies, legal and socioeconomic, resulting from state responses to the outside world shape and limit the strategies available to politicians. While Larsson's extensive archival research findings are drawn from Thai sources, he situates the experiences of Thailand in comparative perspective by contrasting them with the trajectory of property rights in Japan, Burma, and the Philippines.
