This is the first book in English on the Chinese judicial system and its operations in the Republican era, filling a large gap in the scholarship on modern China, Chinese law, Chinese legal history, and comparative law. It offers a richly-textured analysis of how judicial reform initiatives were envisioned and pursued by the central government from 1901 through 1937, how the various initiatives were, or failed to be, implemented at the provincial and county levels, and how the reform impacted judicial practices and power relationships in local society. Xu sheds new light on the reach of the Chinese state and on the complex interactions between the judicial field and administrative field within the state system, and between them and local society. In that context, he illuminates what judicial modernity actually meant for the Chinese state and society and why irregularities, abuses, corruption, and informal practices continued in spite of the reform.

Sino-Japanese Reflections offers ten richly detailed case studies that examine various forms of cultural and literary interaction between Japanese and Chinese intellectuals from the late Ming to the early twentieth century. The authors consider efforts by early modern scholars on each side of the Yellow Sea to understand the language and culture of the other, to draw upon received texts and forms, and to contribute to shared literary practices. Whereas literary and cultural flow within the Sinosphere is sometimes imagined to be an entirely unidirectional process of textual dissemination from China to the periphery, the contributions to this volume reveal a more complex picture: highlighting how literary and cultural engagement was always an opportunity for creative adaptation and negotiation. Examining materials such as Chinese translations of Japanese vernacular poetry, Japanese engagements with Chinese supernatural stories, adaptations of Japanese historical tales into vernacular Chinese, Sinitic poetry composed in Japan, and Japanese Sinology, the volume brings together recent work by literary scholars and intellectual historians of multiple generations, all of whom have a strong comparative interest in Sino-Japanese studies.

In this book Sueann Caulfield explores the changing meanings of honor in early-twentieth-century Brazil, a period that saw an extraordinary proliferation of public debates that linked morality, modernity, honor, and national progress. With a close examination of legal theory on sexual offenses and case law in Rio de Janeiro from the end of World War I to the early years of the Estado Novo dictatorship, Caulfield reveals how everyday interpretations of honor influenced official attitudes and even the law itself as Brazil attempted to modernize.
While some Brazilian elites used the issue of sexual purity to boast of their country’s moral superiority, others claimed that the veneration of such concepts as virginity actually frustrated efforts at modernization. Moreover, although individuals of all social classes invoked values they considered “traditional,” such as the confinement of women’s sexuality within marriage, these values were at odds with social practices—such as premarital sex, cohabitation, divorce, and female-headed households—that had been common throughout Brazil’s history. The persistence of these practices, together with post-World War I changes in both official and popular moral ideals, presented formidable obstacles to the Estado Novo’s renewed drive to define and enforce public morality and private family values in the late 1930s.
With sophisticated theoretical underpinnings, In Defense of Honor is written in a clear and lively manner, making it accessible to students and scholars in a variety of disciplines, including Brazilian and Latin American studies, gender studies, and legal history.

Описание: A brief stay in France was, for many Chinese workers and Chinese Communist Party leaders, a vital stepping stone for their careers during the cultural and political push to modernize China after World War I. For the Chinese students who went abroad specifically to study Western art and literature, these trips meant something else entirely. Set against the backdrop of interwar Paris, Paris and the Art of Transposition uncovers previously marginalized archives to reveal the artistic strategies employed by Chinese artists and writers in the early twentieth-century transnational imaginary and to explain why Paris played such a central role in the global reception of modern Chinese literature and art.

While previous studies of Chinese modernism have focused on how Western modernist aesthetics were adapted or translated to the Chinese context, Angie Chau does the opposite by turning to Paris in the Chinese imaginary and discussing the literary and visual artwork of five artists who moved between France and China: the painter Chang Yu, the poet Li Jinfa, art critic Fu Lei, the painter Pan Yuliang, and the writer Xu Xu. Chau draws the idea of transposition from music theory where it refers to shifting music from one key or clef to another, or to adapting a song originally composed for one instrument to be played by another. Transposing transposition to the study of art and literature, Chau uses the term to describe a fluid and strategic art practice that depends on the tension between foreign and familiar, new and old, celebrating both novelty and recognition—a process that occurs when a text gets placed into a fresh context.

The paradoxes, ironies, and self-contradictions that pervade these works are symptomatic of the hypocrisy, social posturing, and counterfeiting that afflicted both Chinese and European societies at the turn of the seventeenth century. In the early twentieth century, a good number of college-educated Protestant American women went abroad by taking up missionary careers in teaching, nursing, and medicine. Most often, their destination was China, which became a major mission field for the U.S. Protestant missionary movement as the United States emerged to become an imperial power. These missionary women formed a cohort of new women who sought to be liberated from traditional gender roles. As educators and benevolent emancipators, they attempted to transform Chinese women into self-sufficient middle-class professional women just like themselves. As Motoe Sasaki shows in Redemption and Revolution, these aspirations ran parallel to and were in conflict with those of the Chinese xin n?xing (New Women) they encountered.

The subjectivity of the New Woman was an element of global modernity expressing gendered visions of progress. At the same time it was closely intertwined with the view of historical progress in the nation. Though American and Chinese New Women emphasized individual autonomy in that each sought to act as historical agents for modern progress, their notions of subjectivity were in different ways linked to the ideologies of historical progress of their nations. Sasaki’s transnational history of these New Women explores the intersections of gender, modernity, and national identity within the politics of world history, where the nation-state increased its presence as a universal unit in an ever-interconnecting global context.
